Lady hit my bumper.. Questions about how to get paid.
Uhhh, be happy she's willing to settle by paying you with a check to you and Nissan - at least you'll get your car fixed. A check provides her proof you were paid for the damage according to the estimate provided by Nissan, so you can't blame her for that. You asking for cash doesn't mean you'll get it - she could pay you in many ways: cash, check, certified check, money order, travellers check, etc but the bottom line is, she's showing good faith in paying you. If it ends up in small claims court, it's going to look bad on you that you refused payment.
Even worse, she could have tried to screw you by paying nothing but she didn't. She could have also not had car insurance in which case, you'd be forced to chase after her yourself. I would consider it good fortune you're getting paid and wouldn't try to get cash just because your short cash.
But that's just my 2 cents.

+1 This. Hope you didn't get screwed, she can potentially deny all the claims without proof. Who determined that Nissan needed to be added to the check? They aren't the ones fixing it are they?
Make a police report, if the lady doesn't come up with the cash turn it over to your insurance company....that is what you pay them for! You do have all her information right, drivers/car license and insurance?

OP dont play too much hard ball before it back fires and u get nothing at all because she could jus BS and deny everything . and dont wait too long either. the longer u wait on this process to complete the more time she has to change her mind and she was her options are to get out of it
FYI...the check only has to be endorsed by you..the other name doesn't matter....pretty much all insurance companies do that...you just have to deposit the whole check into your account and not cash it. If you were to cash it, then you would probably need both parties to sign off...verify this with the insurance company but i'm pretty sure thats why they have 2 names on the check. I know only cuz i recently a similar incident happen to me...and have her check to see if she will be penalized for it...some companies won't raise your monthly payment if its below a certain amount that they have to write to you...do sum research...and have the insurance check sent to u...
and also, if she doesn't cooperate with u, you can always fill out a police report and report her license plate number to them. Then they will go after her for the insurance info and a WHOLE lot of embarrassment for her too...but if u guys can do it in a civil way, then lets hope she does the right thing...explain the situation about how the amount may not raise her insurance if its below a certain amount...either u or she can call her insurance...i'm sure she doesn't wanna pay that amt...have several more body shops give u a quote if she doesn't like it..and if ALL else fails, u can do a claim on your own insurance and have your insurance chase after her insurance for the money..only issue with that is that u will loose out on your deductible..they will send u to one of THEIR body shops and u will get your check very quickly...(minus the deductible)...hope this helps..good luck
