Lawsuit? For Airbags

I have an 06 g35 coupe and yesterday I got into a bad car accident in rainy weather where I was cut off by SUV and lost control of car..car locked up and spun into the freeway wall smashing the front of my car completely. I was going about anywhere from 50-60 and air bags never deployed..I'm starting to feel pain in my chest and neck was thinking about going to see doctors. Has anyone had an experience like this? I know there is a recall but idk if that will help anything

Forgot to add the airbag light has been going off for a few months now and the "reset procedure" stopped working before the accident

If the airbag light was going off for a few months, is that not your duty to check that out? Manual clearly says if it's on, to have it checked immediately. So..

1. Go see a doctor.
2. Go consult a lawyer.

But, if the airbag light has been on and you didn't get it repaired and still drove, that's more or less on you. Whether or not that's related to the recall, I don't know, but that's why you should talk to an attorney.

You should of had the airbag system fixed a long time ago.

Yea I know I should have but I use to do the reset on it and it worked for awhile..up until a month ago where it stayed on all the time..bills came up and I just didn't get time to do it (dumb my mistake! Lol) I was having can sensor issues and o2 sensor issues so my money and time was I fixing these first. But now car is totaled and now I'm ripping off aftermarket parts so they won't take that with them when adjuster comes

The reset procedure doesn't "fix" anything. he problem still exists even though the light is off. It just takes time for the system to redetect the fault and turn the airbag light on.


All too often the airbag reset procedure is touted as a "fix" when all you are doing is turning the light off and kicking the can down the road. Eventually you have to fix the problem.

Either way, with the airbag light on, you are SOL in terms of Infiniti's liability.

Is there anyway that infiniti can tell whether or not the sensor/warning was going off previous to accident?

If the car is totalled, it's going to be pretty hard to say the failure happened afterwards....especially if the code is for a bad clockspring or some sort of component failure.

You can try, but it's going to be an uphill battle. Talk to a lawyer if you are really serious.

Thanks guys! Was just asking trying to make some money to buy a new car but probly sounds like a hard battle to win

If your car is worth more than you owe on it. You may be able to buy another G with the extra funds but, trying to tie the air bag into the accident when you knew it wasn't working is a stretch. Sometimes when you press your luck, luck presses back.

Yea I figured I'd ask lol. But car won't be worth much as I'm taking off the md exhaust, Berks hi flo cats, short ram intake...I know they will take this if car is totaled and I still owed 2k left..I don't have the oem parts...I'm just going to tell claims person it got ripped off during accident and being towed by two different trucks

Good luck pulling that one with your insurance company. They're typically not idiots, and if you try to pull something like that on them, they might come around and either take the cost to replace that exhaust system from the check they write you (which will typically be a LOT more than if you just replace it yourself since they'll quote you OEM prices), or worst case, try to get you for fraud.

(especially now that you've stated you're going to do this on a public forum, which they may/may not read depending on how far they're willing to go)

^^^ i agree. If you still have the factory parts the insurance company won't mind you putting the car back to stock. In fact, it may bring you more money but, removing parts with nothing to replace them with will be a no, no. Also, talking about committing fraud on this forum may get you jail time if you try to pull it off. Like sponge Bob said, " Good luck with that".

Lol I didn't even know that was considered fraud shows how much I know about this stuff!...yea I'm in the midst of trying to find oem parts to replace...cuz I don't wanna let my 1500$ exhaust go, 500$ hi flo cats..100$ intake...lol I know I won't get my money back for these obviously
