Magnusson-Moss warranty Act

My dealer tried to tell me today that if you have any modification done to your car...even just a pop charger..they have the right to deny even LOOKING at the car. I referred them to the Magnusson-Moss act and they refused to even acknowledge it. What do you think I should do next...call the regional office?

IIRC there is a site explaining the act and it gives you the resources to fight a dealership who won't acknowledge the act.

Tell us what dealership it is.

Good luck with the fight.

Im sure Im going to go through this soon. I just installed my SC and my tranny has been going out forever, grinding 3rd. Im sure Im going to be in for a fight even know the SC has nothing to do with it.

They could make the case that the SC added to much additional horespower / torque and it is more than what the trans i designed for, therefore the trans could have been damaged as a direct result.

It still amazes me how different dealerships are from one another. Some dealerships are mod friendly and some are like the one you have. Is there another dealership in the area you can try?

Yeah i guess I should take it in asap, the kit has only been on the car a week.

They can deny service if they wish since they are a private company.

What they cannot do is void a manufacturer's warranty since they are not the manufacturer. I would write to Infiniti Corporate and tell them that the dealer is refusing to service the car and that any and all warranty related issues will be at the sole expense of Infiniti since you are being denied the right to fulfill the requirements to maintain your warranty.

In the meantime find another dealer, you don't need to deal with dorks.

hopefully you've got a service history with repeated complaints about that problem.

I had a belt go bad in one of my pilots with just a couple thousand miles.
My dealership told me I would have to take it up with Michelin.

This really pissed me off. Yeah I know it's a wearable item, but for them to blow me off like they did irked the sh*t out of me.

So when it's time to buy my next Infiniti, I think I just might go across town to the competition.

Now how much is that $250 dollar tire gonna cost them now?

Yes...any dealer can refuse service to anyone. This was the case with my dealership a while back. A car came in that had twin turbos and all kinds of other stuff on the engine and a few audio system mods, and tinted windows. He was having window problems...streaks and squeaks, and sometimes INOP. Bottom line we dont mess with window issues when there is tint involved unless the customer understands that during removal of the window glass the tint may be dammaged, and that under inspection the problem may stem from a poor installation of the tint so it may or may not be covered by warranty.

Just from looking the writer looking at it you could tell that the felt was rubbed off of the seal so the runner was contacting the glass making the noise. The writer was up front with the guy and told him that it would not be covered under warranty. The customer got an attitude and called infiniti and said that we refused him service this that and the other. Infiniti called our manager who already knew the whole story and told infiniti that none of our personell are trained to operate hevaily modified vehicles let alone service them, so we dont want any liability on our part and infiniti sided with us.

Bottom line is if your gonna have an attitude were gonna stick it to ya just for fun. Its all on how you act. You go in demamding warranty work be done, you get nothing...you go in asking if we can check somthing out, we will do what we can. A lot also depends on your history with that particular dealer...ie: if you bought the car there, had regular service done there and so on.

While I agree with you that it's a dealer's right to refuse service (see my first post), I do not agree that a customer is treated like crap because they "have an attitude" and that it's being done "just for fun."

This type of attitude from a dealer, especially a premium automaker is unacceptable. What should be done is the course of action be explained to the customer in as a simple and professional way as possible.

How would you react if someone just told you the problem is yours and I'm not helping you out with your $30k+ automobile? The dealers need to wake up or their customers will go elsewhere in the future, including to a different manufacturer.

dealers refusing to correct the window streak tsb due to window tinting appears pretty common. however, i think it's a bunch of b.s. the streak would occur with or without the window tint. and the tinting installation would not cause the streak either. it's just another case of a shady dealership.

as far as g35mechanic's response, it's typical and only reaffirms everyone's belief that mechanics and car dealerships are conmen and jerks.

I'd bet a dollar you work for SouthBay Infiniti. They suck butt. I'm so glad I'm dealing with a REAL customers dealership now that I'm in Texas. Grubbs is the best and will get my business in the future.
