Ordered G35 from Dealer..Want to change dealers-advice Plz!
For any of you that Work at a car dealership or have ordered cars in the past - need your advice:
In Feb, I placed an order for an '05 G35 6MT coupe(Athens Blue). Needed to be ordered cause the options I require were nowhere on the East coast at that time. I chose this dealership, because even tho their retail was about $900 higher that another dealership, they gave me the highest trade in Value for my SUV, so overall the net amount was best.
Car is scheduled to come in JUNE. Since I had so much time, I decided to sell my SUV outright and it worked. Ended up getting $1500 more than the dealership.
So now here's the issue: The dealership I originally put the deposit down on - since the deal was the best at the time- is now the worst deal since trade in is not an issue anymore. I know another dealership which sells the G35 for $900 less (didn't choose them in Feb because the trade in offer was so low).
Can I back out of the deal for the ordered car with 1st dealership? I DID NOT SIGN ANY PAPERWORK AND THE $1000 C/C DEPOSIT WAS DONE OVER THE PHONE. Thus they have no signature of me on file..I'm thinking I can use this to wiggle out of the deal. But I also realize that a car that is ordered from factory they are not keen on giving back deposit (the only specialty to it is the Sirius Satellite radio factory installed). Is it worth all the hastle to save the extra $900 dollars? Because then the next dealership has to order the car (or maybe they can get from the 1st dealership once it comes in!!)
What are my best options?

As long as you do not take possession of the vehicle then there is nothing preventing you from backing out of this deal. Since you charged it to your credit card, as long as you did not pay the amount to the credit card company; you can dispute the amount and have the credit card company reissue you a new card.
The only other thing to keep in mind is whether or not you will be taking your vehicle to that particular dealership for repairs.
At the end of the day, they are there to make as much money as possible on your deal and your goal is to pay as little as possible for your new G35. Doesn't matter how nice your saleman is, if given the chance they will screw you over. so save yourself the guilt and do what is best. business is business.

It would be against the law for them to keep that deposit.
Just call them and tell them you would like your deposit back unless they can beat the price of the other dealership. If they try to tell you that the deposit is non refundable tell them they'll be hearing from your lawyer.
900 dollars is a lot of money. I would do it for 50.

If you didn't sign any paperwork for the purchase I would get my $ back. $900 is almost a week of income that could be spend on a very nice dinner and a gift for someone special. Or almost enough to get a new exhaust.

Just tell them your financial situation changed, and that you'll not be able to buy it. Get the deposit back, and if they won't give it back, just call in a dispute. You're not paying your credit card co. for nothing, you know.
I placed my deposit down over the phone too. I asked if it was refundable. The sales guy said that it would be illegal for them to keep it if i decided i did not want to take delivery of the car.

I just called that other dealership which offers the car cheaper. He confirmed what all you guys are saying that his dealership is hesitant to order a car from the factory since, in NJ, it is illegal to keep a deposit..even if it is ordered!

I would be straight forward with them. Since it's illegal to keep your deposit, you shouldn't have to file a dispute with your cc company.
Just tell the first dealer the truth and ask for a price match. Otherwise you would like your deposit back.

When I ordered my 04 6MT from Ray Catena last August, I had to put a deposit (dealer was going to install front lip and rear spoiler). After a few days, I got a quote from Willow Grove Infiniti via email with the same options plus more (XM Radio) for a cheaper price. Since I did not take delivery of the car from Ray Catena, I just asked for my deposit back.
Of course they will try to "haggle" you, but you can get your deposit back.
