From the manual....

For normal acceleration in low altitude areas (less than 4000 feet)

1st to 2nd - 8 mph
2nd to 3rd - 16 mph
3rd to 4th - 25 mph
4th to 5th - 28 mph
5th to 6th - 33 mph

For quick acceleration

1st to 2nd - 15 mph
2nd to 3rd - 25 mph
3rd to 4th - 40 mph
4th to 5th - 45 mph
5th to 6th - 50 mph

 

I'm gonna have to say, you've got room to fight, but it all depends on the judge. The statute you were cited for breaking is very vague which could be to your favor (then again, it could be against you).

I'd fight it.

I was cited for a similar instance years ago. I got a warning ticket for "laying drag" is very specific in what is defined as laying drag in the State of Georgia. I was stopped at a stop sign making a left turn at an intersection, gunned it, and squeeled tires as I went throught the turn. Luckily it was only a warning and I didn't have to fight, but I would have won because there are actually "feet" specifications on how many "feet of drag" you lay for it to be considered laying drag.

Fight it man! Not sure if there are points associated with it or just a fine, but I would fight it cause that sounds like a cop just single-ing you out because you have a nice ride.

Yup, here in NM it's under exhibition of speed (he called it "screeching tires" on the ticket). I got a ticket once for pulling out of a parking lot in my Camaro SS on a Friday night on a very busy street. I gunned it a little to get out on the street before the oncoming traffic got there and my tires lost traction for a couple seconds. Not really my fault and I wasn't trying to race or anything, just trying to get into traffic without getting killed. This cop comes racing up my a$$ and pulls me over and gives me a ticket. It was total BS and I told him I'll see him in court. I fought it and won because the cop didn't show, but I think I would have won anyway. I'd fight it as the cop may not show anyway. I think it's almost always worth it to fight a traffic ticket, but if you lose, you do have to pay court fees on top of the ticket.

hmm ok thanks for all the replies guys! This will effect my points because it is considered a "moving violation." If it had nothing to do with insurance and records I would pay the fine and not bother with it, but I do not want it on my record.

I am pretty sure I am going to fight it. My defense will be I am still learning on a stick, and I misjudged the acceleration and the tires spun. (It was more of a few skips of the tires than a consistant spin, and then I say traction control kicked in, and I shifted. I was not trying to accelerate too quickly, otherwise I would have been long gone when the cop pulled out, but rather I was merely 100 feet in front of him. I misjudged the acceleration of the car, and skipped the tires.

Thanks for looking this up. So am I reading this right? Nissan is saying you can be in 6th gear going 33 mph? I already drove home. Someone drive at 33 mph in 6th gear and report how the engine responds

 

Like chit! especially if you have an ATS Twin Carbon clutch....I can hear the gears like if I was driving a dump truck.

 

That's prob. how they got the 26 miles per gallon number on the sticker. Those number are unrealistic. Anything less than 45 in 6th doesn't feel right to me.

 

The more I think about this, the more it makes me laugh. In two of the cars I have driven fairly extensively the past two years, a Porsche TT and Vette Z06, you have to really concentrate to not chirp the tires, especially when the tires have a little wear on them. Hell, if I lived in that town and drove those cars I'd have a desk full of chirping tickets.

 

I agree with Amp. I dont enter 6th unless at around 45 mph.

I usually shift from first to second at around 3k, but you guys know how short first gear is and how quickly the rpms rise.

 

what does ur car look like and how loud and what kind of music was playing.. to me would be all reasons to pick on u too?

yea no way 33 in 6th.. can u imagine how long 33-70mph would take n 6th gear... **** even 50-70 in 6th gear... cuz i swear i hit damn near 70 n 2nd when i get on it...

Always go to court on all tickets, no matter how worse the situation is. Always take an attorney with you if you can afford it. I have been to court over 7 times, two times i argued for myself and won only once. I always won a case when an attorney walked into the court room with me .... ALWAYS. I feel like the judge respects you more when you can afford an attorney .... its like you are in the 1%

Lucky me, my employer offers a legal plan and I pay like $150 every year and i get an attorney for almost anything (except suing my employer) any number of times a year.

 

I bet you have fun dropping the "Talk to my lawyer" line on people's heads... LOL.
