Sacrifice G-coupe for insurance money ?????

Now, I am not a driver going postal but I really can't stand crazy and bad drivers anymore.

Case 1. I was cruising on a 2 lane road and 1/4 mile down the road I can see a large pick up truck trying to pass a what I can see as a slowing moving u-haul truck. So I'm watching the pick up move into my lane and I began to slow down. To make a long story short, at the end I not only have to slow to 5 mph but I have to swore to my right to the unpave embankment to avoid the pick up truck from having a head on collision with me. Appearantly he was trying to pass the U-haul but I guess the U-decided not to let him pass and the pick up have no intentions of falling back to follow the U-haul.

I was beyond ****, pardon my french, WTF, they both went by honking as to say hey if you valued you nice car you better move off the road. Now, I wanted to hit that truck so bad but because my girlfriend was in the car so I didn't do it.

How much can I collect if we hit head on, lets just say if I were to make it out alive.



I'm trying not to go postal. Thanks in advance to all my fellow g-members.

Exactly, if somebody gets hit from behind, they're not at fault. It doesn't matter if he was going slow or stopped short. You have to keep your distance on the road as to be able to stop if this happens. I know it sucks and it pisses me off too, but if you crashed into this guy you were at fault. You'd be paying for his truck to get fixed, your car to get fixed, and also your insurance would go up high. So thank God you didn't crash.

He said head on, if you crashed it would be the truck drivers fault big time, he was in the wrong line.

I don't think they were stopped and holding up traffic-- they were just side-by-side on a two lane road, headed straight for him. If you'd been in an accident, it would all be on the pickup. You were in your legal lane, he was illegally in your lane. The end. I know this for a fact, as that was the case when a firefighter hit our car and sued us for $6M.

Loooooooong story short, an off-duty firefighter slammed into our Blazer on a snowy day. The Blazer lost traction and slid sideways down the road-- He claimed he couldn't stop (btw, he had over 100 yards to stop, and there was nothing but flat land on either side of him). He then sued us for over $6M. Luckily, our investigator got him on tape saying, "My buddy told me if I slammed into someone I could probably sue 'em, even though it was my fault! Man, my attorney says this family's good for more than a couple mill too! *making Ca-ching noise*". Honestly. Yeah, when we took that to court, he dropped his case. Regardless, the attorneys said at the deposition "You know, your car was in his lane at the time of the accident. This is the law... it was technically on your head." Thank god he opened his big, fat mouth.

If it can be shown that you could have avoided an accident, and you purposely didn't, you are at fault under OR, WA, and CA law, and likely elsewhere. This does not imply that the other driver(s) are not also at fault, only that some or all belongs to you. Right of way takes a back seat to intent in nearly every collision case.

I've pulled plenty of people out of totaled cars (I used to work as a paramedic) and almost all said they wish they could have avoided the incident. Well, almost all of the ones that lived did.

You did the right thing, nice job.

For sure you did the right thing bro. To be angry is normal but it will pass. It helps to vent.....
Screwups like that happen very often these days and it's good that you had your wits about you to take action in preventing an accident.
Believe me, like Shader7, I responded to many an accident in my 25 yrs on the fire department, and those you want to avoid like 'The Plague'. Some are fatal.
That would be quite a chance you'd take to try to total your car and not injure yourself, or a passenger, or someone else.
You did the right thing bro. Let's hope it rubs off onto more drivers and they are more responsible.

there's such a thing as contributory negligence... and, depending on the state, the blame can go to the person who had the last chance of avoiding the accident.. if you'd of hit the guy head on knowing you could've moved, i think it moves out of the realm of "accident" and more to the realm of "intent"... anyway, we can debate about this all day and still not come up with a definitive answer... what that truck driver was doing was plain stupid.. i'm glad you made the smart and logical move and avoided the accident..

the title to this thread should probably be changed to "Sacrifice LIFE for insurance money???" if you guys would've collided, you probably wouldn't lost more than the coupe....

I hate to see accidents-- period. When I see someone passing, and they're either on a double-yellow or in a POS that can't pass, it really scares me. I was almost in an accident because someone tried to pass an 18-wheeler on a 45mph road. I had to pull onto the shoulder to avoid getting hit... scares the crap out of you, doesn't it? *chills*

Everyone's definitely right-- did the right thing. I've always been told this: There are two kinds of people out there- those who are willing to work hard to get what they deserve, and those who want to take it all away from them. People purposefully who cause accidents, etc. fall into the latter category and, in my opinion, reserve themseves a seat in Hades.
