I was driving home last night in my car with two of my buddies from my girl's birthday around 11ish. We were cruising with music (under the speed limit too). We pull up to a light and we stop in the right turn lane. I specifically remember pointing out the cop car to my friends, and it was just normally behind me. I let the pedestrians completely cross the walking path (so i wouldnt get a bs ticket) and proceed to 20mph and increasing. Suddenly, the cops light me up and i was shocked b/c i thought i did nothing wrong. I thought maybe they didnt like the tint and i was gonna get a tint ticket b/c i have 5% tint everywhere. But my freakin windows were all down. Some cop gets out and arrogantly asks me if this is my car (im a young guy so he prob didnt like that i drove such a nice car). 30 minutes after not saying a word to me except "license and registration", his female partner returns my papers and asks me to sign this certain paper. I asked them what i did wrong and they said that I'm getting a ticket for my radar detector, to which they referred to as a "radar jamming device" w/ a vehicle code #. It is another point on my license for what?! I bought the dang thing from Best Buy 2 years ago for $70, it doesnt even work, let alone jam! Firstly, i think they randomly pulled me over and got lucky that they just so happened to see it in my car. My question is, since the vehicle code says its illegal to have a jamming device in the car (even though this isnt a jammer, lets say it is) and it says its illegal to sell them too. So why did Best Buy illegally sell this to me and hundreds of others?? Btw, there's a sticker on the back of the radar that says its legal under the FCC rules and all. What should i do?

Sign not guilty, suponea the officer, hope his shows up and then own his **** on the radar. As radar DETECTOR is not the same as something that emits and jams radar. But you had better go to the maker's website and print the speicifications out.

Radar detectors ARE legal in Cali. Take the unit with you to the judge. That ticket will be a memory very quickly. Did the officer even ask to see it?

Is this the section he cited you? Gather all the information you can regarding the device. Present it to the judge in court and the judge will admit it as evidence. Ask the officer, "is this the device that was in my vehicle at the time of the enforcement stop?, was it in use? was it actively jamming? how did you determine it was a jamming device?" Just to name a few. Bring the owner's manual to court with you. Admit it as evidence. The officer should have seized and booked it into evidence until you court date. You would have been able to get it back after you court date. If it is a radar jamming device, regardless if Best Buy sold it, you are in possession of it. Guilty. Just my two cents coming from the same side of the "pinch book" as the officer that cited you.
Just curious, what was his probable cause for the stop? Pretty hard to tell its a jamming device through the rear window with 5% tint. That's what I would be questioning. Then again, I wasn't there. There may have been another reason. Every now and then, a few people slip through the cracks during their background investigation. I work with a few. I don't mean to second guess the officer cause I wasn't there. I can only go off of what you said happened.

I'm surprised you took it as lightly as you did. I would refused to sign such BS ticket and requested to have his supervising officer come to the scene. But since that is all too late, do go to court and please please file a formal complaint and take it to highest level as you can. This is simply retarded, to get a random ticket w/o any evidence what so ever. I do not believe best buy sell radar jammer, and secondly, I don't believe any jammer would cost $70!! You should of been more aware of what it is you are sticking in your car and stood up for yourself.

If it were only as easy to bring up a pig on fraud/bogus/harassment suit as it is as easy for them to give us a ticket, I'm sure they would be more careful about who they pull over and why.
