ok, so heres the UPDATE.
total loss, nobodies arguing that.
i will take a HUGE loss from the accident though.
insurance will give me around 25k for the car, ill let u guys know the final figure. i owe around 13 on the car. you have to remember, we put 17k down and have made about 15 payments i believe. so no gap insurance since we didnt qualify. and no total loss recovery from infiniti, just from theft.
so, heres the bad part. we will take so much of a loss on the car that i might not be able to get another new G, nomatter the price. that being said, its not the fact of scaling down but the fact that it was 110% her fault and i have to suffer. now, i know im only 17 (18 in 2 months,lol) and most of you are thinking "this kids only 17, he should be gratefull he drove a G at all" but i would understand if it were my fault. so now were trying to see whats gonna happen and i dont know what ill do without a G, i never understood how people were so attatched to their cars until i got the G.
so for now well be waiting the insurance settle.
and if anyone with legal background can chime in, we want to sue the lady for the difference in the loss we will be taking, say 10-15 thousand i believe, is this possible, will we win, etc.
btw, i kept saying "we" because this car was a in actuallity paid by 3 people, with myself paying the second most. gma first, mom last. but i have worked construction every summer and all that money goes to the G, about 6 grand from myself. just wanted to throw that out there before a "spoiled 17 yr old punk" comment came flying out.

I don't think this thread is going to go down with the spoiled teenager group. Sounds like you are one of the few responsible drivers out their. Glad you are alright. Sucks that you are going to be taking such a huge loss. Unfortunately, cars depreciate in value and that is just the way it is. You'll have 12k left over. That should be plenty to get you back on your feet.

Dude, let me start off by saying DAMN, im glad your ok. Second, did you goto a hospital at all? When did the accident happen? If it has been less then a month, goto the doctor. Back pain, anything.. just go for a record of it. Just try and make up some money in personal injury and take her to small claims or somethin. Or take it up with her insurance.

but really, if anybody here has any legal experience in this type of thing please chime in, ill take it as a donation to a new G,lol. i wana sue for her for the loss cuz well be taking a big hit. it this possible, chance well get the money, time fram, etc.

Well good thing you weren't seriously injured, car's replaceable but of course your not.
Hope all goes well with the insurance company and getting what you should out of this.
