you might have a chance for dismissal, but one caveat to think about (IIRC): if you lose, you can't go to school.
my understanding was that if you are eligible for traffic school and go, the ticket and point do not show up. but it's been almost 20yrs since i've looked at a DMV booklet...
i've gone 3 times, never had a point and have never seen an insurance increase as a result.

In Florida (don't know about other States) YOU are allowed to choose to go to Driving school ONCE in your life time, before it appears on your record. After that if a lawyer or you represent yourself and the judge elects to send you to driving school it does not appear on your record, but the Judge has to send you and then I think you are only allowed 1 per year.
Look in the Yellow Pages unless you know someone in your State that has one to recommend. We have one here called "The Ticket Clinic". Cost in FLA is about $90 plus what the judge decides if any, court costs, driving school, ticket etc.
Plus the lawyer knows all the tricks to drag it out and get it thrown out.

If you fight the ticket and the cop doesn't show up to court its thrown out and you're home free. Pesti Try it. If you go to school the ticket will show but if you record is clean now you shouldn't have any insurance issues

i don't think the mistake is big enough for this to be a sure thing... and if you can't choose to go to school if you lose, then you're screwed.. the only sure thing is the school.. but it'll be costly..
but if you lose, it'll be even more costly..

If memory serves, in TX, you got a ticket (the fines for speeding were listed in a table on the back side), you had to go to the courthouse to request traffic school (usually given w/o a problem), then you'd pay the traffic school fees and about a $35 court administrative fee (the speeding portion of the fine is dropped), and be done with it, and you weren't eligible for 12 months.
Now I'm in CA. Here in San Diego County, you get the ticket, then you get a letter from the DMV with a list of approved schools. You can go to traffic school, get a certificate, and mail the certificate and a check back to the court. Then you're not eligible for traffic school for 18 months. In CA, you still pay the full speeding fine in addition to the traffic school. If you do traffic school, your insurance doesn't go up -- that's the incentive. The list of approved traffic schools I received included several online internet schools. Some of them require you to go to a notary public to prove your ID, a couple of them didn't and you could do everything from home with a credit card and an internet connection.

Another thought, pesti; since you have the accident on your record that will probably boost your insurance anyways. So it might be worth it to fight the ticket even if you can't attend TS if you lose. Just a thought.

If you take traffic school, your insurance doesn't go up. That's the big incentive to take traffic school, after all. The idea is that you re-train your defensive driving skills to become a better driver so you don't have another accident. Of course, the execution of that plan is a bit poor, but the insurance companies still buy into it and give you the break.
Of course, you'll probably be a paranoid driver for the next 18 months like I was.

I agree, but my point is that his insurance will go up due to the accident, so it's worth it to fight the ticket even if he can't do TS due to fighting it. They should both drop off the radar screen about the same time - I think it's 3 years.
