A manufacturer could face liability if something were to happen...

I considered trying to get a JDM shorty shipped over... I think that would be the most viable option (as expensive as it might be).
IDK, couldn't they just sell it “for off road use only” or “not intended for use in the US” some crap like that to bypass that kind of stuff? Kinda like people do with lights and whatnot? Also, the bumper cover itself has very little to do with impact resistance, it's the foam and brace underneath, if that is removed, then any liability should rest on the owner or whoever removed the extra cushioning/support right? Not that where liability should rest and where it is placed ever have anything to do with each-other.

the diff with the bumper and other "off road use" parts like HFC, Headers, etc - is the safety factor.

Let's face it, we're in a litigious society. Whether it's "right" or not is not my concern as much as the "chance" that legal issues could arise.

It's not my place to tell someone what parts to make... but I know I wouldn't open myself to potential "injury" liability. (must just be the field I'm in that make me realize the potential problems.)

All too true. And I'm not trying to say anyone should make the part, just offering an idea.

It just pains me that as a society we allow ourselves to be governed, not by justice, moral sense and reason, but rather to be governed by an endless amount of rules and laws spawned by idiots, criminals, and lawyers

^ Undoubtedly it's because they're built differently underneath. I'm sure Nissan would not have bothered making a different bumper for the US market if they didn't have to do it to meet whatever requirements.
