I can't see videos when at work. What MPH are you trying to set the cruise at? I have an early 03 sedan with the 3.54 gear set and have no problems setting the CC at speeds below 78mph. I've never tried any higher. Your report of a flakey CC with 3.54+ gears is not uncommon. Others have reported similiar problems in the past when trying to engage CC at speeds above 72mph.
Don't you have an aftermarket higher stall TC? Here's what I think may be the problem and it may be related to the cooler. When trying to set the CC, are you certain the transmission fluid is completely warm? Cold weather, teamed with a aftermarket higher capacity cooler may not be allowing the fluid to fully warm up unless you drive for an extended period (20 minutes). I've noticed in sub 40 degree weather that my 5AT will not achieve full TC lockup until I've been driving for nearly 10 minutes, most of which is highway. It will do partial lockup, but not 100% lockup at cruise. Since you have a higher stall TC, there is more TC slippage at cruise and possibly higher cruise rpms under load and without TC lockup. The additional cooler may be keeping the fluid from reaching operational temp which is when the 5AT will achieve full lockup.
In layman's terms:
Fluid does not fully warm therefore full lockup is not achived -> Unlocked higher stall TC has slightly higher cruise rpms under load -> Deeper set gear results in higher cruise rpms -> Elevated cruise rpms and unlocked TC results in rpm cruise range that is out of spec with what the ECU expects to see with a OEM TC and 3.3 gear and/or thinks you trying to set the CC 89mph+.
My recommendation is to reset the ECU (to clear CC problem), drive around for 30 minutes to adquately warm the fluid, get on the highway, verify the TC is locking up at a steady cruise at 70mph, and attempt to set the CC.

There's your problem. You can't do that with the 3.5 gear or you'll flake out the CC. You need to reset the ECU or do a handful of restarts. It should clear. You need to disengage the CC before proceeding past 80mph or you risk this issue in most* 5AT's with deeper gears.

Well, since you have this gear and you now know what causes it, you can do the footwork to get some more information on exactly what situations cause the cruise to wig-out.
For example: if you hit 85 with the cruise turned on but not set, does it freak?

Well daveb you are right the car is fine now after sitting for almost 12 hrs lol...... Now what did accur. While driving home I wanted to see the maximum mph that my cc would engage at. It engaged at 60mph also at 75mph and also at 90mph. Hhmm.. But after the 90mph try about 15 seconds in after cc set at that speed the problem came back any ideas for that or is simply that I cant cc above 85mph. All the other trys it set and cc just fine!!
^No Nissan cruise will set over 90.
Granted, it won't freak out and stop working until you restart the car, just won't set.
You need to try setting it at 75, 80, 83, 86, 88 and see where the problem comes up.
Or, just start at 78, and hit the accelerate button one press at a time to increase it one mile per hr at a time until it gives a problem.

^There was no comma.
For all modern Nissan cruises, 90MPH is the highest speed you can set them to, or accelerate them up to. After that, they simply will not set. (Unlike my Trans-Am which was content to set at 140
)
