I think you should get the guys address and kik his ***!

Hope they fix it right... You should ask for more money than what it costs to fix as a collisioned car's worth is less than one with 100% original paint. Just whine and you might get what you deserve out of the situation.

You are entitled to claim dimunition in value for your car. Your insurance co. is not gonna be much help for u. U have to deal with the parties at fault's ins. and they're gonna give u a run around.

What state are u in? if u're in CA and your dimunition in value is less than 5k, take the bastard to small claims.

Good luck

I am in AZ, and i plan on filing a dimunitive loss claim on both companies of the vehicles that hit me. I am prepared for anything they have in store for me. If I have to I will take them to court myself if they don't pay up. right now I am still waiting for the final figure on how much it is going to cost to fix my car. thanks again to all for the help.

Why do you think his insurance company wouldn't be any help to him? The earlier accident I posted about, they fool didn't have enough insurance to cover all the damages, (3 or 4 cars) so I turned it over to my insurance, and they dealt with his, his company paid my deductible. I wasn't aware you could claim diminution of value, thanks for posting that!

You only want to involve your insurance company if theirs is not dealing with you. The bad news is that it still becomes a claim against your insurance who in turn goes back against the other company to get reimbursed.

I am working with the other person's insurance right now to get diminished value on my wifes G. She was hit in side impact and the damage is about 18 grand but they did not total it.

Well guys, I just got back from the dealer, and after we worked out the numbers, I got another 05 g35 for $450 over invoice. But the hard part was that I had to come up with an additional $1800 out of pocket for the value of my car. I can't wait, I pick up the car tomorrow.

That is what I would have done. Go after the guys insurance company for the 1800 bucks. Frame damage = get a new car time.

Ok if it has been 6 months - you essentially paid $300/month in depreciation - so it didn't work out that bad for you.

DingoNY, $300 a month plus 7000 miles = use of vehicle. I know that I will get about $5-6K for dimiinished value. How does this not work out in my favor??

That is essentially what I was saying

My 15k mile lease rate is $450/month - you did alright, although it sucks it didn't happen just as the 2006's are becoming available
