There were no injuries. The girl sitting in the passenger seat was a little freaked out b/c she was very close to being hurt. I have to talk to the adjuster on monday to give my side of the story....i

i still want to know what's wrong with Mercury insurance.

Dude Mercury insurance is the worst carrier ever...

I got into a collision just like yours...I was driving straight and some shmuck in a minivan cut across a blind intersection making a left from the opposite direction of traffic....

I only had a second to respond, not enough time to brake completely....so I turned right to avoid hitting him and I ended up hitting him from the side instead of head on...

He's lucky I did that too, he had three little kids in the car and if I hit him head on it would have been much worse. The kids were fine, and at the scene of the accident he even admitted guilt.

Unfortunately I did not get a police report, and Mercury is claiming the accident is partially my fault because I did not hit him head on.

I have had a lawyer suing them for the past 3 years now, and it's still not resolved. I hate Mercury, and it's not just me. They are notorious for not paying out on claims against them.

I hope everything gets fixed for you ASAP and I wish you the best of luck.

First of all, we don't investigate "accidents." We investigate traffic collisions. Accident infers that nobody did anything wrong. Obviously not in your case. In your case, the other party caused this collision by driving in violation of California Vehicle Code section 21801(a) VC- The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety. Second of all, you are not required to have a report. All you are required to do is exchange information with the other involved party. I'm not sure where this occurred, but if you need a report, go to the police department of the city that the collsion occurred in (or if unicorportated go to the local CHP office) and file a 'counter report'. Or just call your insurance company, give them all the other parties info, and the witness info, and let them fight it out. Don't mean to be long winded but, if you cars are driveable, get them out of the roadway. Even if tires are rubbing and parts are hanging off, you not going to damage it that much more. I'm just saying this because from the looks of you picture, both of you left your cars in the intersection and screwed up traffic. If your car was completely immobile, I can understand. If that was the case, the PD should have come out there.

2 policemen did stop that were passing by. They were nice and made sure everybody was ok and that we had exchanged our info. I have nothing against police...they are great...i actually have made a few friends that are traffic cops that give tickets in my neighborhood.

As for the cars...i couldnt physically turn my key to turn it on. It wouldnt let me.

As for her car it was steaming/smoking...

I agree 100%! I see so many minor fender benders where both cars are blocking traffic! Move the damn cars to the side! People seem to think that they have to leave the cars EXACTLY the way it is or otherwise we can't figure out whose's at fault. Which is obvious false, you can tell by the damages to each cars.
BTW, glad to hear that nobody is hurt.
