If you do have UI insurance, and if you are injured, you can make a claim against your Insurance company without having your premium go up is my understanding.
No you're correct. Even if you have full coverage your insurance may not pay for your damages if the other driver was uninsured, underinsured, or did a hit and run accident. Unless you have this coverage, then you are liable for the damage.

I'm always taken aback at how absolutely reflexive that kind of thinking has become anymore; pretty frightening really.

So what happened? Are you good in getting this covered by insurance?

I was rear ended once by an uninsured motorist. The damage wasn't bad but visually noticeable. I got screwed because the cost of damage was roughly $500 and my deductible was that...... So I just ended up fixing it myself to save the paperwork.....

Well, the reason i say that was b/c he tried to flee the scene. If he just stayed there then all is good. If that was me i get a lawyer and sue. I hope you got a copy of that police report.

Yeah, well if the at fault motorist tried to flee the scene, it may mean he doesn't have insurance. If the OP has a deductible, he will have to pay it, so he's out either way.

What does that have to do with making a fraudulent injury claim?!!

Sounds like some kind of twisted "two wrongs make a right" kind of reasoning. The only trouble is that you wouldn't be making him pay more, you'd be making everyone else who buys insurance, people who had absolutely nothing to do with this accident, pay for it; essentially just robbing everyone else because something unfortunate happened to you.

The point here is:

If you get rear ended by an uninsured driver who won't pay for the repair of your car and depending on your opinion, the diminished value, you should go to file at a small claims court.

There will be a $100 filing fee and some time required out of your day but in almost all rear end cases, you win. You will get your repair $ along with the filing money back if you win.

Other than that, if you feel like going after them because you were injured or not, it is all up to you. But just know that if you were rear ended, most of the time you will come out with a meaty settlement.

The cough and winks were supposed to indicate a joke.
But in all seriousness, a hit and runner deserves some bad karma his way and this is one of the ways to teach him a lesson.

WOW, that's a serious pile of it right there pal. Must be awfully nice to know that YOUR moral compass is so divinely calibrated so as to determine what's fair above and beyond the law for the rest of us mere mortals.

Similar thing happened to me in my F23A aka 2001 honda accord, Got Rear ended by a durango , dude gave me bogus insurance info , Refused to wait for the po-po and left .
Luckily for me here were about 20 witnesses and i got his plate number . The cops and the insurance agency did everything .
he was 100% at fault his insurance paid for everything

A person that will do a hit and run is the same kind of worthless POS that would key your car. If you were lucky enough to get his plate number, I would pursue it through insurance and law enforcement so I get the money for my time/damage and put him/her in jail. Put someone in jail for hit and run!? I would sleep just fine at night.
