Just not my summer...
Just not my summer...
a few of you know that i had to put my car back to stock for a while because i got a couple tickets. well those tickets got denied! so it was pointless. and i wasted money changing my tint to legal.
a couple nights ago some dump girl backed into my car. $790 worth of damage, she gave me $570 cash, which i took because she was suppppper sweet, and the damage isn't THAT bad.
Now tonight, i got pulled over on my bike. the freeway was totally open, no cars in front or back of me. so i hit some pretty high numbers. slowed down to speed limit when i started seeing cars, and then i see blue lights. ticketed for no registration card, because i took it out earlier today while cleaning. I also have to got to court for speeding. He didn't know how fast i was going, but said that he had to go 120 to catch up to me (which doesn't mean anything). So i really hope that i don't get really f'ed by this, because i can't afford to pay a higher insurance.
I think the officer also forgot to give me my license back.
Either that or he just took it. Which i didn't think they could do. He didn't say anything about it. so how do i get my license back? ...i kind need that. heh.
any help or advise is greatly appreciated.

man that sucks. me and my friend were speeding on bikes on the H1 west bound, going about 120 and saw a cop on the side of the road. We decided to pull over immediately, just so we didnt get into anymore trouble. but he only gave my friend a ticket for speeding because he was in front of me. my bike had cali registration and cali insurance and my friend didnt even have his bike license, + he only gave my friend a ticket for going 80mph nothing else. i guess cops in town sUk a$$.
Brah **** the poh-leese. I straight up tell em. **** YOU!! Right after I race em too.
Honestly, some cops are jerks, others are cool. Keep in mind though that when you break the law, you do so at your own risk. Things like recon are petty IMO and a lot of cops are cool about it and don't even bother with minor things like that.
Speeding at 120 though...eh...there's a lot of gray area with this one. No matter how much it sucks to get pulled over, it's the driver behind the wheel who makes the decision to plant his or her foot (or in your case, twist the throttle) into the carpet. Even if the road is deserted and clear in front. Unfortunately the law isn't gray, just black and white.
The only gray area is in how they catch you. The cop who pulled you over will have to say that he PACED you to PROVE that you were speeding if he didn't catch you on laser. Saying he had to speed up to 120 to catch you says nothing. You could have passed him at 60 when he was doing 45 for all you know and he may have just needed a lot of ground to catch you. What if he just fell behind traffic and the distance between you two opened up over time? Saying he had to speed up to 120 also doesn't prove you were going 120. It just proves that you were very far ahead of him. I met up with friends in Haleiwa a few days ago. They were already there and I was in Wahiawa. I could have sped up to 120mph to catch them, but that doesn't mean they were doing 120 in their PT Cruiser (don't ask).
Also, what was the cop driving/riding? If it was a solo biker I can understand. A Crown Vic though...120? Oh please. You know how long it takes a Crown Vic to hit 120. Guarantee he would have lost sight of you before reaching you if he had to speed up to 120 mph. If he did lose sight of you, how does he know he got the right bike?
Think about what he said carefully and you'll see that there are many ways you can fight this. The judge will more than likely ask if you're willing to admit you were doing say 70-80 and they'll ask you to pay for that. To me, if you reeeeeally don't want to pay the ticket, you could probably prove that they can't prove how fast you were going and get out of paying the ticket all together. How hard you're willing to fight and how much responsibility you're willing to accept is up to you though.

Dayum...that sucks. I don't think the cop can just take the license like that. If he did purposely take it, you probably would've been asked to call someone to pick up you. At the same time I'm pretty sure your bike would be impounded. I'm pretty sure you could get a duplicate license from a satelite city hall. If anything they would tell you if you have a license stop or not. As for your ticket, there's not much you could do. Hope the cop doesn't show up to court and assuming this is your first offense, the case could be dismissed w/o prejudice. Depending on your past offenses and the severity of them, the court may refer you to a public defender.
On the bright side, at least you got cash to pay for some of the damages on your car.

yeah, it was a crown vic. he defiantly lost sight of me. the ticket says "Exhibition of Speed", which i just found out is worst then regular speeding. i heard its equivalent to street racing/ burnouts, etc. with jail time as a potential sentence....

same thing happened to me a long time ago. this was just before they started that 25mph over thing though. you need to get an attorney. i got this dui lawyer to represent me for reckless driving.
and if you say you saw blue lights when you slowed down, how do you know when he saw you. he may/may not have lost sight, the freeway has some pretty long stretches. either way, your fu**ed if he said he didn't lose sight, i know cops bend the truth. why is it okay? cause they know you did it and they can go to sleep at night knowing that they didn't just mess with some innocent biker obeying the law.
if you know a cop who can get a copy of the report, that'd help. i gave that to my lawyer. i ended up with 1yr probation. sounds bad, but its a hell of a lot better than jailtime or insurance hikes.

I'd play the what exactly is "exhibition of speed" and what exactly was I doing wrong card and then force them to prove it. Since it'll more than likely come down to "he said, she said", it helps if you have a clean driving record.

One of my colleagues is a specialist in traffic stuff, his name is Pat McPhereson. He's very easy to talk to and a very stand up guy. Most of all he's very reputable in traffic court. His number is 537-5600; he's located in the American Savings Bank Tower on Alakea on the 12th flr (I think...he just recently moved to a different floor). I recently had one of my friends go see him on his case of wreckless endangerment. hopefully all goes well with his case as well.

I just got out of one of those... ****en dumb ***... said he was pacing me. ****en Ford Explorer. Said I was going 57 in a 25... there were no speed signs and I was on the on ramp to the freeway. BEST advice, get an attorney, not the court appointed one but a private one. Preferrably someone you know, like a friend or family so they dont milk you. They probably would charge over $2500 for their services.. haha But the alternative could be worse. 30 days jail. I think the fine was $3000 and they have something called a SR__ somethin along those lines, Which ups your insurance 4 times. So get an ATTORNEY. Your best bet is to get it reduced. you probably cant get out of it. but definitely take pictures of the area you got pulled over. Mines got dismissed with prejudice due to the NEWLY instated speed limit signs on the Moanalua onramp east bound. lmao punk *** cop!!! So mines cant be brought up again and will not affect my insurance even when they see my abstract.
