Need some advice Accident

Need some advice Accident

Ok, i need some help here guys. Got into my first accident today. Luckily it wasnt in my G, it was in my girlfriends corolla, and shes extremely pissed at me >.< its just a little fender bender so no one got hurt. Anyways...i was backing out of my spot and i was about maybe 5 inches out and some lady hit me. (or i hit her) Initially i thought it was my fault because i backed out and like 99% of the time its the person backing up that is in fault. This is my first accident so i was kinda shocked and nervous. So anyways, i got out of the car and sort of admitted that i was in the wrong. it was in front of a quicklys so there was about 5 people that saw the accident, or atleast came out afterwards to look, but no one said anything. So technically, neither of us have witnesses or anything. I offered her $150 but she wouldnt accept it, and wanted my insurance which i gave. There is nothing wrong with my car except for a chip about the size of a 20 font period. Her car is like a 99 corolla and her front left fender is dent about the size of my butt, and her corner lens cover fell off. Now that i think about, and have talked to a couple of people, im beginning to think that SHE was the one who hit me. Now i offered her 150, but she didnt take it, she even told me that she would call me in the next couple days to tell me if shell take it or not..my question is..if she comes back asking for more, im obviously not giving it to her because its not worth more than 150..im just gonna say get the insurance involved. But at the same time, should i make a 180 and start saying that she is the in the wrong? or is it too late..this is way too long for anyone to read but hopefully some of u guys will give me some advice. Heres what im thinking.. i think she hit me with the side of her bumper and that transfered the energy and created that dent.

Well I can tell you after working 9 years in insurance, if you can pin this on her that would be the first time I have seen it. Best thing I think you can hope for is a 50/50 scenario in mot parking lot accidents. Doesn't mean there is not a first time for everything, and there may be more to the story not stated in your description. But basically under the vehicle code the person backing has the greater duty to maintain a lookout for traffic already in the lane and yield to their right of way. But she also has some responsibility to be on the lookout because in a parking lot anything can happen. The old saying we like to use in insurance is "What if it had been a kid that ran out from between the cars? Would you blame the kid?"

But on a positive note it looks like the damage is fairly minor and no one was hurt. If I can be of any help let me know.

Thanks cyber. My dad looked at the pics and said that it looks like she hit me because there are scuffs on the front of her bumper and she hit the side of my car. Also the scuff marks are dragged across her car. if i was the one who hit her, wouldnt it just be a bump or something. I mean..if u really wanna argue it, if u look closely at the last picture of her car, and look at the black scuff mark, the paint looks pushed up. What do u think my chances are if i argued it like that cyber?

Have her show you an estimate for her repairs, then decide to pay out of pocket depending on amount. Or say Eff it and lets go insurance route. Then as said above what could happen that way.

I'll tell you right now that's more than $500 worth of damage easy with dent in metal side fender. Or was that already there and just bumper scuffed.

yea thats the thing...i mean..is it even possible for a piece of plastic to bend metal? lol. Which is unfortunate because she will probably say that i created that dent..

Hard to say and not an expert. Does seem weird for the type of impact that happened and where, to crease that fender that much if at all.
Possibly some strong mount tabs at that section. Again not an expert.

damn leo, just wait til see what the lady says man. right now you cant do anything til she calls you anyways. but try the cash route because you dont want it to go the insurance its a hassle and will raise your premium. but good luck man.
