i got a question... if u have CS2 and when the CS3 comes out.. can u update it or do u have to buy it?

If you have a legal version of a previous edition of photoshop then they usually offer a considerably cheaper upgrade package.

The edjucation discount is probably the best legal way to go for a full version.
