You mean if some idiot speeds up and tries to cut me off, and I don't let them in that I'm drag racing because I'm preventing them from passing? What is this world coming to?

Heck, everytime I'm at a stoplight I take off faster than the car next to me, we're both going to the next stoplight, so does that mean I'm drag racing?

Can be looked at in another way too, I should have been a lawyer.[img]/w3timages/icons/wink.gif[/img] If you are trying to pass someone and they speed up or even if they do not, then you could be considered racing for trying to pass.[img]/w3timages/icons/frown.gif[/img][img]/w3timages/icons/crazy.gif[/img]
How about if someone is tailgating or on your A$$ and you just want to get away?

Some of the wording there sucks for us.. but I do like this bill. All the dumb honda kids who think the streets are their track make it dangerous for EVERYONE. God I sound old now, hahah!

hate to break it to you guys, but this statute hasnt changed in years. They only changed the fines for it and the penalties if caught. Speaking as a Law Enforcement Officer, we know who is out there racing and who is just driving fast.

Just keep in mind this...." from the same point to the same point, for the purpose of comparing the relative speeds or power acceleration of such motor vehicle or motor vehicles within a certain distance or time limit." If you are just driving on a roadway, its hardly defined as racing. There has to be some sort of "competition," as I put it. Just two cars driving 55mph in a 45mph zone does not constitute a drag race. Two cars driving at an increasing speed and not slowing down would define a drag race in pretty much anyones eyes, no?

As far as someone tailgating you and then you speeding to get away, thats going to land you a ticket anyhow because it is much easier to just put your blinker on and change lanes, no?

Hey SuperCharged6MT,

If you don't mind my asking, what type of LEO are you: city (e.g. officer), county (e.g. deputy), or state (e.g. trooper)? I have two cousins (one MDPD, one BSO), and they along with my other LEO friends all give conflicting answers on stuff like this. I'm sure State Troopers or local Motormen might also have their own more stringent interpretations.

For example, I've heard that in South Florida, you can generally cruise safely up to 9mph above the posted limit (such as on I75, Turnpike, I95) without getting pulled over (of course, I'm assuming here you're driving safely and not tailgating or weaving around traffic)--just cruising. Then I've had some tell me that once you get caught going 50 mph above the speed limit you MUST be arrested, while others say you just get a really massive ticket if you were just cruising and not endangering anyone else. It seems everyone has their own views.

Are the laws just not well defined?

I just have a question about how u yourself drive.

Having a Supercharged G35....im sure u dont just go the speedlimit or 5 over. Im also willing to bet that you "have fun" at lights. So, lets say one of the times you "have fun" the z28 next to you wants to show u up. Even if u didnt know that he also was going to floor it off the line it would have the appearance of racing. Im totally against illegal racing BUT i personally think that flooring it on green until you get to the speedlimit or a little over should be completly legal EVEN IF the person next to you is doing the same thing, given that you dont continue to increase your speed once u hit the speed limit.
In that since and that since only, this law is B.S.

Answer is simple. You can get stopped for doing 1mph over the speed limit, will anyone enforce it? Highly unlikely. You can ask your cop friends F.S.S. 316.074 is a violation of a traffic control device, which means if the speed limit sign (the traffic control device) says 45mph and you are doing 46mph, it is a violation. This is strictly a technicality of the law and like i said, highly unlikely to be enforced, but it is POSSIBLE to be ticketed.

Now... If any of you have been issued a ticket in Broward (I can only speak for Broward b/c I understand their fines, etc), the pamphlet with the smiling joker on the front says INSIDE that 6-9mph is $XX.XX fine. This means that you CAN be issued a citation for speeding for 6-9mph over the limit and beyond. If you are going 1mph-5mph over the limit, FL statute states that you should be issued a WARNING. Your L.E.O. friends can also look up that statute under F.S.S. 316.189.

Now, the 9mph on the highway thing. That is a general rule of thumb. Most Troopers, etc will not stop you traveling 9mph or lesser over the limit, although legally they can, its just not worth the stop, there are worse out there. I leave a 15mph buffer before i stop someone to issue a ticket, which means 60mph in a 45mph zone is getting you a ticket, 59mph will not, but thats just me. Unless it is a residential area, this is just a rule that I follow for myself.

50MPH over means you MUST be arrested? That's horseshit. Traffic stops and tickets are ALWAYS at the discretion of the officer UNLESS it is an area in which they are doing saturations for speeders, etc due to citizen complaints, traffic fatality rate, accidents, etc. Generally if you are doubling the speed limit it constitutes reckless driving which is a misdemeanor and is an arrestable offense.

The laws are somewhat well-defined in most cases, its just how the officer perceives it, everyone has an opinion or interpretation. I know it's not the answer you want, but its really hard to say.

For the record, I am a city officer, certified by the state of FL as a radar/laser operator.

In response to your post.... I do not have a Supercharged G35, just as well as you do not have "da bomb." Its sarcasm, settle down. It's simply my goal right now to have one. You are absolutely right, I do not do the speed limit nor do I do 5mph over. I usually travel whatever I feel is safe, without being an idiot or hipocrite. I use judgement and do not abuse my position. I also do not see a problem with traveling 85mph+ on the Turnpike through Ft.Pierce area at 3am with no one on the road, yet I still get stopped too.

And if a Z28 pulled up next to me and wanted to go, I do have the willpower to drive normally. Moroso is where I would take a drag race, not the public streets. Either that or Sawgrass XPWY at 3am, which is usually dead. I don't condone that, I would just rather see someone out there than doing 100mph+ down University Drive.

I do believe that in your post you did just tell me that you and the Z28 were "racing" to get to the proper speed limit. Which to me is "racing" which will land you a ticket... Drive normal and everything will be ok.

As far as the law being BS, My thoughts have always been "dont bitch about the problem if you aren't going to help with a solution." What I mean by this is, I really don't envision you out at the state capital petitioning the racing laws, therefore I really don't think its anyone's place to complain if they arent going to do something about it. no offense, because thats not what I am attempting to do, just showing a difference viewpoint.

Thanks for the info Supercharged but Neff i dont think I have anything to "retract" The Z28 story was hypothetical and but i have had similar instenses where I was not "racing" i was flooring it off the line and the guy next to me did the same thing and i didnt know he was going to.
As for Supercharged's way of driving...it is very similar to mine...i drive what I feel is safe (or under)...when I had my civic, 85 in a 70 with not too much traffic felt safe to me...with a G35, i think with no traffic 100 would be safe but Im not going to drive that!!! unless i find myself on the Autobon one day

Plus, the 80 in a 45 u speak of was with NO OTHER CARS in site..until the cop pulled out and turned on his lights...and at the moment I hit 80, i hit the brake and went down to 65

but I admit I was wrong last night...i wasnt tryin to call out the cop for abusing his power or whatever, just to try and show that things MAY not be as they seem...for example, last night, me and Ian were not racing since we both took our foot of the gas ever other second and were just playing with each other.

but thanks again Supercharged...I like your way of patrolling and keeping us safe...I have been ticketed for doing exactly 10mph over and wasnt too happy but the law is the law i suppose.
