Wow that sucks but I had a cop mess with me worse, I'll tell you the story in person. Should be able to fight it.

what the hell? i'm totally confused here - is it illegal to have an aftermarket exhaust, period? or, is it illegal to have an aftermarket exhaust that does not meet CARB and/or higher than a certain db rating?

Some advice for you
You have two choices:

1) You just pay the fine when it arrives in the mail. The last time I did this, I cost me approx. $150. The fine is probably more now.

2) Set a court date, go to court and plead "Not guilty" to set a date for Trial. Setup an appointment with your local Smog Ref. They supposedly have decible meters now for measuring exhaust noise. Go there and have your exhaust tested by them. If it passes (i.e., if it's under 95 db), they should give you a certification. You then take the paper to your Trial to show the judge that your car has been tested by the State Smog Ref to comply with the law.

I'm not a lawyer, but I've fought 3 of these modified exhaust citations before. I lost one of them and ended up just paying the fine. The other two, I won. However, this was before the Smog Ref supposedly was equipped with decible meters. So I had to show manufacturer's certification in one case, and in the other case, the Judge made me go to a CHP office to have an officer there certify it.

It all comes down to this: How much time do you have to spend? If you can take time off from work and go through the trouble of fighting it, do it. If not, it's probably best just to pay the fine. The State makes it hard for you to fight these citations on purpose because they make TONS of money off of it.

As far as I knew, as long as it's a cat back system and not too loud, then it's completely legal. Your HKS shouldn' be much louder than stock. Seems like he was just a cop that felt like being a ***** or meeting his monthly quota. I'd definitely fight it.

Ok I'm not going to comment on the Oinker and Pig comment because you're talking to one. Is your exhaust not an aftermarket one? Here's the California Vehicle code in regards to your situation:

Modification of Exhaust Systems

27151. (a) No person shall modify the exhaust system of a motor vehicle in a manner which will amplify or increase the noise emitted by the motor of the vehicle so that the vehicle is not in compliance with the provisions of Section 27150 or exceeds the noise limits established for the type of vehicle in Article 2.5 (commencing with Section 27200). No person shall operate a motor vehicle with an exhaust system so modified.

(b) For the purposes of exhaust systems installed on motor vehicles with a manufacturer's gross vehicle weight rating of less than 6,000 pounds, other than motorcycles, a sound level of 95 dbA or less, when tested in accordance with Society of Automotive Engineers Standard J1169 May 1998, complies with this section. Motor vehicle exhaust systems or parts thereof include, but are not limited to, nonoriginal exhaust equipment.



I thought when you purchase an aftermarket exhaust system, the manufacturer provides you with a certificate which states their system complies with California's decibel levels? If I were you, I'd call HKS and request this information. If you wanted to show this cop, have CHP test your exhausts' noise level and if it meets the 95 dbA, you're off the hook.

I also thought that HKS exhaust complies with the 95dB limit. If possible, get yourself a certificate from HKS and show it to the judge and hope he's cool about it. On the other hand, we all know you got the 'meat ball' flag for Laguna Seca's 92dB threshold! MeeeeeeeeeechiN!

TPD sucks ... You have to be careful in Torrance.

I was super lucky not to get tickets down there when I had the Z. Right now in the South Bay cops are out in force LAPD is strong right now in Wilmington too.

I've seen more unmarked cops out on the fwy's too.

Dood! That wasn't a meatball flag for noise.
It was an inverted Japan flag.
They bring it out when they see a JDM car.
