Ticket in SOCal

OK, i made a thread before about the BS ticket i got in Santee and i went to my first court date today and plead not guilty. I decided to look up some info on the charges because they are trying to charge me $900+ for speeding and illegal lane change. Now, as im reading this info about what is written on the ticket, its marked as "Exhibition of speed", so i looked up that. look what I found

23109. (a) A person shall not engage in a motor vehicle speed contest on a highway. As used in this section, a motor vehicle speed contest includes a motor vehicle race against another vehicle, a clock, or other timing device. For purposes of this section, an event in which the time to cover a prescribed route of more than 20 miles is measured, but where the vehicle does not exceed the speed limits, is not a speed contest.

(b) A person shall not aid or abet in any motor vehicle speed contest on any highway.

(c) A person shall not engage in any motor vehicle exhibition of speed on a highway, and no person shall aid or abet in a motor vehicle exhibition of speed on any highway.

(d) A person shall not for the purpose of facilitating or aiding or as an incident to any motor vehicle speed contest or exhibition upon a highway in any manner obstruct or place a barricade or obstruction or assist or participate in placing a barricade or obstruction upon any highway.

(e) (1) A person convicted of a violation of subdivision (a) shall be punished by imprisonment in a county jail for not less than 24 hours nor more than 90 days or by a fine of not less than three hundred fifty-five dollars ($355) nor more than one thousand dollars ($1,000), or by both that fine and imprisonment. That person shall also be required to perform 40 hours of community service. The court may order the privilege to operate a motor vehicle suspended for 90 days to six months, as provided in paragraph (8) of subdivision (a) of Section 13352. The person’s privilege to operate a motor vehicle may be restricted for 90 days to six months to necessary travel to and from that person’s place of employment and, if driving a motor vehicle is necessary to perform the duties of the person’s employment, restricted to driving in that person’s scope of employment. This subdivision does not interfere with the court’s power to grant probation in a suitable case.


So basically, this cop wrote me a ticket saying i was racing, but I wasnt racing anyone, I wasnt trying to beat some kinda clock or timing device or any of the other BS that they are claiming. I hate this damn area, I miss the east coast. I am fighting this ticket though, cause its total BS. at worst, i was speeding not trying to race anyone or anything

i cant catch a break in anything lately. so im fighting that ticket in court, this is just too much BS. the one ticket i got for speeding, I deserved, so i did the whole traffic school thing and didnt try to fight it. but this one, is just rediculous. to me, that says that a cop can make up whatever they want to if they want to, and the rest of the public just has to deal with it. Now, If I was racing someone and got caught doing it, I would just take the punishment, but this is just nuts

dude dont worry about it too much. I mean exhibition of speed is a misdemeanor comporaed to a plain speeding violation. Stick to your guns but it may be a little false depending on the judge. My honest opinion is hire a ticket attorney. You may pay 200-300 in fees but itll save you 2 points on your record, premium on your car insurance, and save you all the headache. Hire a good defense attorney that "Only gets paid if they win the case." Theres plenty that operate that way so yes my friend. Fact is you were "speeding and you made illegal lane change" from what you said above. All the judge is gonna do is read that and say yea that sounds like exhibition of speed. If you say something like I did signal but the officer didnt see my blinkers because it was during the height of the morning when the sun was shining bright.lol dude ill help you out as much as I can Shawn. but from what im reading, exhibition of speed is actually worse than a normal speeding ticket. Its one step below a drag racing ticket

And if/when you get off this ticket, you'll be completely free. They cant even nab you for speeding. If they cant pin that ticket on you, they cant introduce a new ticket/violation... unless he ticketed you for it already.

yea silverbolt is absolutely correct. Depending on the judge though. I mean if they find you not guilty in court and the case out the window then your good. IF they find you guilty, you can try to get the violation reduced and ask him to reduce the fine and its at the discretion of the judge. Its all in the judges hands though so yeap. Doesnt really matter if the cop is there or not since it is a misdemeanor. Its between you and the judge.

peeling out is exhibition of speed....but I think your speeding may fall under:

(c) A person shall not engage in any motor vehicle exhibition of speed on a highway, and no person shall aid or abet in a motor vehicle exhibition of speed on any highway.

Was there another car around you at the same time weaving in and out of traffic?

If you fight it: Whatever you do, don't say you were at most speeding and not racing anyone/thing. If you say you were speeding, that's admitting to breaking the law.

Never peeled out, so that cant be it. this ticket was in Santee which still goes to El Cajon court
