I think the 3% difference rule is for comparing the front tire size with the rear. If you do that, a 225/45/18 tire is still within 3% of the 245/45/18. Some ppl here have run this combo w/o any issues (i.e. vdc, slip light, etc).

As of now, I will be dropping my car off Monday morning at which point they will remove the rims, unmount the tires, send the rims out for 3-4 days, put my car on jack stands in the parking lot, and I will drive off in a rental car. I should be back in my car by the end of the week.

I have debated jacking the car up in my garage and just bringing in the wheels, to prevent any additional damage from the tire shop jacking up the car and putting it on jack stands (there is a lot of underbelly plastic just waiting to be damaged). I am not too excited to spend even more of my time taking off my wheels now, putting them back on later, and maybe having to drive back to the tire show to have the tire pressure sensors reprogrammed. Also, if I do leave my car at the shop, I'll do a walk around with the manager to confirm that there are no dents or scratches on my car, and I expect that it will remain that way.

Anyone have any thoughts? This has been a very time consuming set of new tires.
I would have went with the OEM wheels as long as that is what is on the car now regardless of what they were not too excited about doing. Refurbished, remanufactured, all indicate that they are wheels that have been damaged in some manor, maybe minor, maybe not so minor. As long as yours were undamaged when it went in, they should have been undamaged when they came out and it was not your fault beyond maybe not paying attention when you took the car back. Of course most probably wouldn't check it over that close either so you would be considered a 'reasonable person' in that regard if you took legal action.

I too would prefer to go with the new OEM rims. However, I am trying to be reasonable as I appreciate the very high cost of new OEM rims. Also, they could have told me to get lost, requiring that I take legal action to get any results.

As for the remanufactured part, they will be repainting my rims. I was very clear that I do not want another's old rims (repainted or not), for the same reasons you noted.

I am hopeful (albeit concerned) that everything going forward goes smoothly.

They could have told you to get lost and then been exposed to new OEM rims, legal costs, and so on. The issue on your side is to show the damage most likely occurred at their shop. Note this would not be a 'beyond a reasonable doubt' (especially since they have stated they were missing the spacer for the machine) since it is a civil case. The way to do this would have been another shop or even Infiniti looking at the rims. I am almost surprised there isn't a tire damage as well unless you had stretched fitment. Even if you had previous damage it is usually easy to tell recent damage.

In any case I hope you end up satisfied with the direction you go and it is possible that I would also go that way if I figure it was the most grease free at the time.

Sounds like I should have retained you to deal with this for me. Are you an attorney?

I think everything should work out okay provided my car remains unscathed this week at their shop.
