car accident

I had a minor car accident on Dec.20.2003 with my G.

I was at K-town to drop my friend off at the travel agency for her trip to Las Vegas. It was exactly 8:45 in the morning.
Becuase lots of people were dropping off their friends and family there, the tiny parking lot was full. So when I was getting out of the parking spot(that lays N-S) there were two cars which kinda double parked(E-W) behind of my car. I was backing up to the road from the parking lot. And I was approximately driving 5 mph at the most.
This 80 year old frxxk was on the road, not in the parking lot, he was about to make a left turn into the parking lot. The road is full of street parking cars and he stopped on the middle of the road. So I missed to see him. yeah, that was my fault.

I hit his left front bumper only.

we got off from the car and was planning onto exchange information. The guard at the parking lot, he even said that

"Hey, Mr, she is like your grand daughter age, and the damage was not even that bad. Only thing you should do is just putting the front bumper back on to it, Just let her go Don't go through her insurance"

the frxxk goes"okay, let's go to body shop and you pay, do you know any good body shop in LA?"

So we drove to the body shop that I know well; however, the place was not open yet becuase it was Saturday 9am.
After we found out that place was closed, we stuck in the traffic. He got out from his car and he pretended to be really nice grany,,,"Hey, Lady, you seem like you busy now. I also need to go back to the mall where my hospital is at, so why don't we just talk on the phone?"
We didn't have really any minute to take time to exchange our info each other becuase we were totally blocked the narrow road.
we just exchanged the phone numbers and names and I went to the precruise of Dec. 2003 meet. As everyone saw at the meet in city of industry, there wasn't really damage on my car. It just pushed his bumper out. (btw, his car is 98' Chevy some green color sedan)

He called that night, ans said he won't claim it.

The next day, he called me again around at 5pm, and he goes
"You might not want to deal with this becuase you are busy worker,... "----->who said I'm working? By the word he put, i found out that he was pretty assuming that I have enough money ..

"Anyways, I must claim your insurance company, becuase I've gotten a serious headache, my knees are hurt, my back hurts........so I just called you letting you know that I am going to claim toward your company"

I knew that he won't get as much as he want from my insurance company cash for his pocket money. The damage was only $100-$200 for labor to put the front bumper back on, the insurance company will not pay for his hospital and I was going to give him some extra $500-$600 for not claiming. I already knew he goes hospital 3times a week for his knee.

He said that he got some advice from his friends, they said he would better go to hospital for not getting sick. then started to complain about his pain everywhere.
So I talked with my insurance broker friend, she said "let him whever he wants to do he won't get it, Don't worry"

Since he claimed it to my insurance company, I haven't gotten any papers from my insurance company to confirm the accident.

Today, I got a release form in full of claim that they was needing me sign on it. I am definately not going to sign on that paper. I found out there were TWO persons' name. How can he do this to me? I was really trying to be really nice becuase he was korean like me, he is alot older that me like my grandfather so I treated him with a respectful attitude to talk. I didn't want to be rude or anything.

He wanted to get money out of my insurance company.

I'm not letting him get money out of my insurance.
As I know, it's big different between that I have one driver in other party's car and that I have two or more people in other party's car. Because if the passenger is also hurt, that kinda proves that the accident was pretty big.

I called my insurance claim representative right away, and left a message to him. I don't want them to give money to him and his faked passenger. I said I will do go to court, if they wanted me to show up for state for truth.

He made me pissed off, although I tried to be nice. I let him do whatever he wanted, but at this point, I never ever let this two person claim go wrong.

My insurance guy will call me tomorrow, I will let you guys know.

Gowners, be careful, please. Don't let go like me.
I had such a bad luck,....headache...

That sux... I've learned from my first accident, you always make a police report. This way you get 2 statements at the scene and you have something to fall back on. It doesn't mean you have to go thru the insurance. It just means if the other party decides to fake you out like so, your @$$ is covered from a possible story change like so.

I would get the security guards name and statement.

If he does claim 2 people in the accident.....and you prove that he was the only one.....isn't that illegal?

Wow. What a crotchety old sh*t. Unfortunately the statute of limitations on this is 2 years, so he can keep trumping up whatever he wants until that point. See if you can get the airport's records on who was working that day, and contact the guard. Make sure you tell the guard "Remember, I was driving the G35, and he was in a green Chevy? Older Korean man?" etc. It's not leading him, as it's thing he'd recall anyway. When he gives his testimony, he'll recall some things he wouldn't have if you "prime" him with the truth.

Do you have an umbrella policy on your coverage? Whatever you do, don't let him know JACK about your financial status. My arch nemesis in highschool's father was a lawyer... when we got hit by an off-duty fireman, HE represented him and sued us fot over $6M. Some people just suck at being human beings.

Is your insurance company retaining a lawyer? GOOD LUCK!

Ham, work it out with your insurance. If they catch him for lying, that's insurance fraud. Call him up and tell him that, it's all about scare tactics. You have to be courteous but tough, be persistent. I had to do the same with a lady who hit me and then said she forgot her insurance but gave me her phone and license #'s. Later on found out she didn't have insurance because it was cancelled. I didn't want to pay my deductible so I just shot threats at her one after the other about sueing, reporting her to dmv for no insurance etc...then the check came. Reverse the situation and don't let him take advantage of you for more than you're really liable for.

Give me 3 years when i get outta law school i'll provide my services for free...

Always always always no matter what get:

Drivers license
Name, address, and phone number
Make sure it is current address
Proof of insurance
Insurance policy no
Insurance address & phone number
Car make, model , color
Names, address, drivers license # and ssn(if possible) of all passengers and witnesses.
Write a description of each witness and passenger
Car license plate

Make sure you always have a cell phone, pen, and paper with you in your car. Kewl that infiniti already gives this to us.
If the other party fails to provide you with the above information, immediately call the local law enforcement agency and report the incident as a hit and run. Do not use 911 for this unless it is a medical or pending medical emergency or you are in danger. Call the local law enforcement directly or through information.

If he's starting to lie about the accident, I think you should deny everything too. No one has a police report so there's not proof of anything. You can even say he hit you. It's almost impossible to tell now....that's unless you told everything to your ins. co already. I'm not condoning unethical behavior but this old man is making me pissed off taking advantage of a girl in a nice car. keep us updated on how it turns out.
