It's a frivilous lawsuit with someone just trying to grab some money.

Infiniti has already stepped up to the plate, and they're covering the brake jobs. I believe the replacements are with a newer pad material that reduces the problem, as well.

Wrong on that! I have had my brakes replaced 3 times, at
15K intervals. Infiniti replaced them at 30K under the brake
warranty program. Those pads wore out in 15K miles.

did they replaced your rotors free of charge as well? Or just pads?

My front pads were replaced and rotors were resurfaced at 11k. Now at 15k it started squeaking like crazy again.

There's a reason they beefed up front rotors/calipers on 05 models. Since there was no significant weight increase I take it Infiniti acknowledges the fact there was a problem with original design. I will be monitoring this lawsuit closely. Maybe there will be a TSB as a result to replace 03&04 front brake hardware with 05 version. That would be sweet.
