Tagged and towed (long)

After playing full day vball tournament on Saturday, my GF and I went DT to the distillery district to watch a play that her friend produced. As you all know traffic and parking was ridiculous that night because of the TTC Strike, we were running late so we parked in the first spot we saw on Mill Street, bought a ticket from the Green P, and off we went to watch the show.

The play started at 8:00, and ended at 9:05, after mingling for a bit we decide to head home cause its been a long day. We were walking to my car and the street looked kinda empty.... Great my car had been towed.

My GF started to freak out more then me as she knows how much I love my car and it was her idea to go and watch the play. I told her no big deal we were in rush and didn't read the sign properly, no point in getting mad,let just get the car and go home.

We jump in a cab and head to the impound lot. 105 bucks to get the car out and 60 bucks for a parking ticket. the ticket was issued at 8:05pm and my car was towed at 9:05pm.

I start asking the kids(they looked 16) that work there, how do I report damages to the car as it is night time and I cant really inspect my car till the next morning. They give me this big song and dance how there will be no damages blah blah blah.

I drive my car under the only light that is there and start inspecting my car, no damages I can see to the body or rims but I notice some marks on the bottom corners of my front fender.

I Call the kid out and ask him to write a damage report, he starts getting mad and confrontational, and claiming the tow truck didnt do it, I tried to explain to him that my car is lowered and its not that easy to get the tow equipment under my car, the kid then goes on a rant about how his car is lower and they have no problems towing his car blah blah blah in the end the kid finally fills out the report and we head home.

Here is my question. I cant say for sure that my fenders were not damaged by me, however when they filled out the tow invoice, they marked there were no damages to the car, however when I picked up my car, I noticed some damages. Do you think I can get them to fix and repaint my front fender?

Second, question, do you think I could fight my parking ticket? I clearly parked in a no standing area, however, I did buy a ticket thinking I was legally allowed to park there as there were lots of cars parked in the same area who also purchased a ticket.

Sucks to hear; but you probably will not win if you try to fight that ticket.

Your only defence in case like this will be a technicality or an emergency; which in this instance is not. There were no signs indicating you were allowed free parking if you held a ticket and you never did clarify with anyone if you were allowed to park there. Your assumption or what your actual intent was in a case like this is useless.

You might be able to get the ticket to be dropped to a different price if you phone the parking authority and explain your situation but if you already filed that damage report and the person you spoke to indicated on your record you were acting rude (which in your case is reasonably expected); you might not get a reduction.

I am not a lawyer (yet; haha) though so it might be better for someone else to chirp in here with more experience.

For the damages; hope that gets all cleared up and you get your car back in the same condition it went in.

Yes, but Who never answers his emails. Who might know, but never shares.
WRT the damage, your prob. SOL, but if your temperment will allow, go after the tow company. GL

I say fight the ticket, there is a chance the cop won't show

I don't think cops have to show up for parking tickets, not like a moving violation.

To answer your second question, you clearly parked in a no standing area, whether or not you buy a ticket or if there were lots of cars parked in the same area is irrelevant, just means that all of the cars that were parked in the no standing areas were also illegally parked.

I say pay the ticket and chalk it up as lesson learned.

LOL, good to know that it's not just me that has that issue with who.

damn man...i remembered when they towed my g away cuz i parked in a pizzahut parking lot to go to class for just freakin 5 mins..class was cancelled...i went back and my cars gone...what the hell...good thing i didnt paint my kuramaz bumper yet...
