Got in an accident...Questions

Got in an accident...Questions

2005 G35 coupe approximately 40,000 miles
This month marks the 2nd year of when I first got my G.

Yesterday, I was driving on the right lane of a 2 lane street. Guy on the left didn't think he could stop for the car in front of him, so he swerved into my lane. Hit my car and pushed me into up the curb. Had to dodge a freakin pole and finally came to a stop.
He admitted 100% his fault. (It was raining.)

Today, someone from the insurance company came and took pictures of the damages of my car.

I asked his insurance company if they will compensate for the time that I have to take off work to fix my car. They said that they are only paying for the damages.

Is this possible?

1. Do I not get compensated for the depreciation value of my car, due to the accident.
2. For the time I have to take off work.
3. For a rental car which I will need to get to work?

What are some things that I can do?
I'm pretty sure I won't be paid for my blacked out 06' headlights, or my clear corners. Alignment is pretty bad, It feels like I'm taking a left turn as I'm driving.

Arg...so sad =(

you have to fight for everything and not sign anything until you get the terms you want.

good luck fixing your own car, they'll send it to the cheapest place in town and then pay some of that but i doubt they'd pay you for your time and labor if you DIY

the guys insurance company has to go to the shop you want to go to and you should get a rental car...

tell them what you want

Do not sign ANYTHING Tell them that you are getting a lawyer and going to go to the doctors to have yourself examined as well from the crash. Often times whiplash and other injuries do not immediately cause problems or pain.

They will likely wise up and if not then get the lawyer and see the doctor -- you wll be happy you did if they want to play hard ball.

man exactly the same thing happened to me but in my case the guy is not admittin his fault and he says i hit him when it is clear that he went through my fender and pulled my bumper out...and my car is only 5 months old (07 G35C)....gl man atleast u r in good situation compared to me

I was in a really bad accident with my honda accord last year so some things are still fresh for me.

The guy that hit me had Progressive Insurance and they were complete dicks about assisting me with my accident so be prepared for that. I was rear ended and he too admitted to 100% fault.

1. Do I not get compensated for the depreciation value of my car, due to the accident: Yes you can be compensated for the depreciation of your car, but be advised there is a lot of paper work filing and YOU have to provide how your car would depreciate and the appraiser will determine if you get the value or not. VERY LONG process but don't let that deter you.


2. For the time I have to take off work: YES, esp if you were injured. You should be compensated for the time off of work if it is related to your car. That means if you didn't have another car and you need a rental and they haven't provided you your rental car, YOU NEED TO BE COMPENSATED for that time off. I too had to deal with this.


3. For a rental car which I will need to get to work: Yes. He admitted fault, you can't get to work, you need to be compensated and have a rental car. Now this is how they got me w/ the rental car. They would pay for the cheapest car on the rental lot (cobalt or kia spectrum) and I took that. Oher wise you will have to come out of your pocket to pay the difference of a nicer car.

If your car is totalled you will have a certain amount of days to find another car if you have a rental depending on what the other person's insurance policy states.

If you were injured your medical bills should be covered. I also used the medical that comes with my insurance and this didn't make my premium go up.

If all else fails, Get a Lawyer fast. I didn't have to get one, but now that I look back I should of gotten one because my process took WAY too long.

Good luck and I am happy you are ok. You are first and foremost.

DO NOT SIGN ANYTHING without reading or with out a Lawyer if things are getting shady. It will pay off in the end I promise you.

^ all thats right asside from the rental car

you are supposed to get a car at least equal in value to the one totaled in the accident..which is deff not a cobalt.

this is why I needed that lawyer. Progressive was not budging on getting me a better rental car, so I just settled with kia and let it be. If I could do it over I'd of called a lawyer quickly.

where are you located? In california that cant force you to have repairs done anywhere, you choose the shop. Get estimates from up to 3 shops, but if the cars drivable you really cant.

Im not sure, they have to wpay for your time off work. I dont believe so, but a lawyer would know. Good luck!

Remember that if you do get a lawyer, he will get at least 33% of any settlement that you receive, so you aren't always better with a lawyer unless you are injured.

Never let an insurance company look at a car in a drive way. Always go to your shop. Its your right in most states.
