Texas law states rear end collision is always the person that is behind you that caused the rear ends fault. Not the other way around.

I was not ticketed--I was not at fault. When there is wreckless driving--there is an exception. Take that up with HPD, not me.
And, their insurance paid--NOT mine.

Yeah I got screwed once when I got into an accident. A lady in a subaru hit the lady in front of her, and it being stop and go, I didn't stop in time and hit the subaru. The thing is, one of the ladies didn't have insurance, and the other didn't have a license. So technically, I was the only one "legal" there. But they pinned the whole accident on me, me being the one in the rear.

When I was 16, I almost got side-swiped, and trying to avoid that, I rear-ended a lady. The cop was nice, and said that technically it was my fault regardless of the situation, but didn't write a ticket. He said the hit to insurance would be enough (boy, was he right!). Unless there are witnesses, in Texas it doesn't really matter what the person in front did, the person in the rear is always at fault. But regardless of fault, wrecking a G sucks.
