Small claims court may be your best venue. You have lots of things going for you.

1.) Proof of purchase of the hood by you from Top Secret.

2.) Proof of purchase of the hood by UT from you.

3.) Proof of delivery and acceptance of the hood by UT.

4.) Proof of the transaction and binding agreement (Ebay records).

5.) Proof of non-payment by virtue of reversal from PayPal.

UT really doesn't have a leg to stand on IMO.

Yeah, ^^^ I agree. I remember this thread a while ago. I can't believe you are still battling this out. You can count one thing, I wouldn't do business with a company that does business that way.

Ya, I have spole w/ paypal many times, and they are unbelieveably hard to deal w/, I get one story from one person and then another from a different person..aaww its so frustrating. Paypal always seems to favor the buyers side versus the sellers side.. dont know why, but Iam not done dealing w/ them that is for sure...
what do you guys think I should do before sending this to court?
thanks for your support

Yes I have been thinking about that ... that is deff. in mind right now ... and if I do choose to take this to court they will have to fly out here to California from New York, which will be quite $$
I dont know why they have not resolved this yet ...

And most of them were deleted.....

There are productive ways to resolve your issue, and this isn't one of them. If/when resolution arrives, will you come on every G35 forum you can find and post the results? Nah.

Meanwhile, there are 3 sides to every story, and even if UT buys you a new car, their rep is damaged.

I own no parts from UT, BTW. I just want business issues handled in a businesslike manner. You have the advantage of being to say/do whatever you would like in the pursuit of your goal, whereas UT must play by the rules.

Please follow the channels. It can be frustrating, but you can keep your pride.

I agree on some of your point but this is not his first time posting this, his first thread had TopSecret (even vouching for this guy and confirmed that Guy35 info were accurate), UT and himself explaining their side of the story. It has been over a month and the thread was deleted right away with out any resolution If that was me I'll even go further and start complaining to BBB and other agencies.

One of the lessons I learned a long time ago with PayPal, DON'T leave ANY money in your account. That way the Aholes at PP (Ha, kinda fitting, they can be real dicks) can't get at it.
