If he was completely at fault, you will have to see what their insurance will do. At the very least, they should pay for your immediate medical expense and the value of your car at the moment before the accident. However, considering the nature of the accident, I would expect to be paid to replace the car. A stern talk to the insurance company should probably afford you this. Otherwise, I would consider legal action to be fully reimbursed for the car so that you can replace it fully. I have never sued anyone, and I am not suggesting for you to get more than what is necessary to take your life back to what it was before this accident. I just would not want to be out of pocket anything for such stupidity. This depends a lot on what the police record indicates as the cause.

I am curious though - how on a two lane road did the two cars collide in this manner?
Your G's hit in the front and their car's actually hit on the passenger side
- were you both heading in the same direction and did they perhaps try to pass you and then cut back in too soon?
- or were you heading in opposite directions and collided as they were losing control?
Just cursious how they got perpendicular to you at the time of impact

take a look at the skid marks in the 1st picture. It looks like the eclipse lost control and slid into the left lane....probably sideways...and then got T'ed up by the G.

Glad you're okay, that's the main thing. Yes, there is a God and you should be thanking Him for your life.
As for paying your car off, as long as you have no blame for the accident, your insurance will pay the book value for your car. If you don't have gap insurance, there will be a gap between the book value and what you owe. It's better than nothing though. You can sue for the rest but there's no guarantee on that. I'm no expert and anyone who is can correct me.

Glad you're ok. As for the other part of your post. Your insurance will pay the value of the vehicle before the idiot killed it. The check will most likely be sent to your financial institution that holds the title. You will receive the difference of the payoff amount and the value of the car. The difference will vary depending on how much of a downpayment you made on the vehicle and how many payments were made. Basically the equity you have invested.
Been in 2 wrecks where cars totaled, both were at fault of 16 yr old female drivers pulling out in front of me. First accident I was the passenger in my buddies brand new 3 series bmw. Girl pulled out of side street, we bounced of her and shot into a ditch going about 50-60 mph. Air bag hurt like a bitch didn't it. These new cars are designed really well to absourb impact. Just like u said, thanks engineers at bmw. Second was my jacked up chevy Z71 on 35" tires vs ford torus. T-boned it going 45 mph. I miss that truck. 16 yr old playing with radio blew straight thruogh stop sign. Girl was in a coma for a week with broke neck and leg. She had a 100% recovery thank God. I've Been very lucky, looks like you were too. Be careful everyone.
