TRUCK Hit Me!
Here are the pics:
It really makes my heart cringe...
Top view:
Will the hole need to be covered up to prevent anything from getting wet? I'm guessing not, but please correct me if I'm wrong.
View from the front:
Another view:
Damage of the bumper. It also seems to be misaligned. I'm guessing the truck's weight crushed my car downward:
Notice the gap at the headlight:
Here is the condensed version of what happened:
The truck was a flat nose truck. The passenger side corner of what carries the cargo hit into my car. The front edge of the truck’s “cargo box” wasn’t even damaged. There was only paint transfer from my car.
This is the truck that hit me What is the x'ed part of the truck called? :
This is a paint version of what happened:
I was making a right turn. A truck that was behind me decided to cut in front of me even though there was no room. He kept on going and eventually crushed my car.
My driver’s side front fender was crushed. The truck punctured a hole into my car. My headlight is damaged. It looks like it was crushed downward. My front bumper is damaged. It seems misaligned. My hood doesn’t open. I don’t know what else is damaged. The whole time my car was STATIONARY. I should not be at fault because my car was not even moving at the time.
It would be very unfair to me to have a blemish on my insurance record because of what an inexperienced truck driver did to my car. I still haven’t contacted my insurance company yet. What should I do? I am so lost. Can I sue the truck driver or his insurance company to pay for all of the damages? I tried contacting traffic lawyers and accident lawyers, but they don’t work on this kind of case. What other lawyers should I contact? Any advice would be greatly appreciated!

Please tell me if it is detailed enough. I plan on just reading this to the insurance company if I have to. That way I won't leave anything out. I want to make sure they know that it wasn't my fault.
What happened.:
I was making a right turn from a two way street, X street, into a one way street, Y St. X street had 6 lanes in total, 3 going south and 3 going north. I was going south on X street. One lane was for parking and two lanes were for traffic. There was a double parked minivan on the right traffic lane. I was forced to make a right turn on the left traffic lane into Y street.
Y street goes west bound. Y street has enough room for three cars but there are no lines drawn on the streets. I will split them into three imaginary lanes. The right and left “lanes” had vehicles parked on half of the block. They were on the western part of the block.
I made a right turn from the left traffic lane of X street into the left lane of Y street. I decided to stay on the left “lane” of Y street in anticipation of a left turn at the next light. Traffic was backed up, so I was stuck in the intersection of Y and X. A truck that was behind me pulled next to me and tried to get into the same lane I was in. There was no room for him to pull in the lane, but he forced himself in. The whole time my car was STATIONARY. I was honking him to warn him to stop. He stopped for a moment, but then continued to move. Then BAM! He hits into my car. At this time, the passenger of the truck told the driver to stop. Nonetheless, the driver continued to move a bit more. He finally stopped. Later I had to move my car from under him to park and wait for the police.

I used to be an auto claims adjuster...based soley on the facts you have given(other contributing factors you may have left out can change the outcome of who is negligent and how much) I would say the other driver is at fault for failure to keep a proper lookout, failure to yield right of way and making an unsafe lane change...traffic laws and ways of handling insurance vary from state to state and I never hanlded NY...but in general terms...you are supposed to report any accident to your insurance regardless of fault...more than likely the truck that hit you is owned by a business and they carry a commercial policy...in most cases trying to deal w the commercial policy insurance directly is a big pain in the a$$! I would try to deal w them directly for maybe 2 days...you might get lucky...but if you get no where w the other insurance carrier, the fastest way to have you car repaired correctly will be through your own carrier...
