I don't know how things work in your state, but over here, all you would need to do is just write down their insurance information. Whether the driver has a permit or license is irrelevant. The insurance on the vehicle that hit you, is what is going to cover it...

If the driver was not covered because they weren't supposed to be driving... (Like if the kid didn't have a licensed 21 year old next to them), then typically your insurance would pay out, and then sue the owner of the vehicle and/or their insurance company.

But if the kid did have a proper adult with them, especially if the car is the adult's car, then there is no reason the insurance company wouldn't pay....

I talked to the kids uncle today, he's going to cover the damages. Nice guy & a man of his word. He gave me his insurance info again & said it was his fault.

How it happened: I was driving in a parking lot & he started to back up. I honked but he kept coming. I gassed it but couldn't get out of the way. His radio was all the way up & didn't hear the horn. I was pissed but the kid almost started crying when I got out of the car. I did the adult thing & didn't kill him.

In Texas it's the car, not the driver. Estimate in the morning.

I lived all over the U.S. Once again, this proves that this is the only State I've ever lived in where there's a majority of people that don't know how to drive. Rain or Shine...a lot of people here in Texas just don't know how to drive. And what's the deal where on a stop that they have to come right up your rear before they stop?

thats rough...atleast u got there info and they are being cool about it.....a few years ago my car was hit in a hit and run while i was in eatting lunch.... that was a big hassle 1200 in damages...but a 500 deductable.... was just a mess.......

That's precisely why I installed a 139db Air Horn in my G. I had a few near-misses in parking lots before when people apparently couldn't hear my horn.
