Not necessarily. Look at Acura. In 03', the 3.2 V6 was LEV and made 260HP. In 04', its ULEV and makes 270.

Nearly ALL of the '04 meet the new emissions standards, because the production started in Oct of '03.
And I was reading a road test of the '04 350Z that ran 13.7 bone stock the other day. This is a faster time than I've ever seen published for the 350Z. So I'd have to say that if anything, the '04 350Z may be quicker than the '03. Although probably not... they probably perform exactly the same. Maybe that '04 was just a particularly strong runner....
