There's nothing wrong with a replacement new engine, provided its installed properly. Replacing an engine isn't that bad of a job. I would rather have a dealer replace an engine than have them pull the engine and try to rebuild it with new rings, valves, etc. THAT requires trained engine builders with a good shop, which IMO is beyond most dealership capabilities. But as long as they're not going inside the engine and are just swapping an engine, I wouldn't be too concerned.
I don't see how you could get a whole new car when just the engine is bad. You would have to sue them under the lemon law, and if you're engine was only attempted to be repaired or replaced once, you're not going to have a good lemon law case.
I know it sux, but you just have to deal with the hand you've been dealt and make the best of it. Keep in mind you'll still have your full warranty, so if they screw something up with the engine swap, just keep bringing it back until they get it right.

My '03 Coupe never needs oil between changes but I know of a sedan here in town that belches white smoke on start-up and the dealer has ordered up the overhaul kit for it. Sounds like alot of down time to me. Also, he will not get a loaner and it IS under warranty.

Sorry to bump this topic up again but I have to get this off my chest and ask for a few opinions. So I brought the car in to the dealer because it burned through nearly 3 qts in 3700 miles and they changed the oil and told me to come back in 1000 miles to check it again.
First off, when I picked up the car it was sitting in literally 8 inches of water thanks to hurricane Ivan and the dealerships close proximity to the ocean (trust me, I still screamed my head off). So I drove the car home and let it sit for several hours because I wanted to see how honest the dealer was about monitoring my oil consumption. Well, I pull out the dipstick a few hours later and surprise surprise they overfilled the car about 3/4 of a quart. Needless to say I wasn't happy, but I figured I'd give it another shot because the engine was still warm from driving it earlier in the day. So I let the car sit overnight and checked it in the morning… AGAIN the dipstick read WELL above the full mark and at this point I have smoke coming out of my ears. Now for the (not so) funny part:
I call the dealer and start giving them the guilt trip about how dishonest it was of them to overfill my car when we are trying to monitor my oil consumption (which would obviously give a reading WELL in the dealerships favor making me look like an idiot). That’s when the service person asked me whether I checked it when the engine was cold, to which I replied "Of course the engine was cold, it's the only way to get a 'true' reading as to how much oil is actually in the motor." He replies, "well actually you'll want to start the car and let it run for 3 or 4 minutes to get the oil up into the parts of the motor because it is all sitting at the bottom after the car has sat overnight." To me this sounds like a load of BS because if I'm trying to measure how much oil, in total, is in the engine then I would obviously want it all to settle to the bottom. Can someone give me their opinion on whether or not this sounds like a load of crap?
The reason I think it's BS is because the way I got the original reading (showing how insanely low it was in the first place) was by letting the car sit overnight, and if that’s going to read OVER what is actually in the motor then that means I burned through even more oil than I originally thought, making the situation much more severe.
This whole situation sucks. Now I not only have to keep an eye on my oil, but I have to keep and even closer eye on the slimey dealer. yay...

thats why dipsticks have cold and hot marks on them. if your past the hot mark after sitting for a night, wait till you check it really hot!
generally you let an engine warm up and then turn it off and let it sit for 10 minutes before checking to allow the oil to drain back into the pan for an accurate reading.

I had always understood the cross-etched marks to be the "ideal zone" and anything above that is too much and below is too little. I was not aware of hot or cold marks on the dipstick, just "FILL" and "FULL."
