Best thing is that you're ok, trust me in my business I get to hear of many ppl that aren't so lucky

regarding fault, you're going to be at fault for hitting the 3rd car. If you stopped without hitting the 3rd car and then the truck rear ended you into the 3rd car then you aren't at fault and the truck is fully at fault........however, that said, I don't know how believable that story will be since your front end damage is significantly worse than your rear (at most the truck just bumped you further into the car ahead)

At this point your focus should be on getting all your mods off the car ASAP and arguing with your insurer for greater compensation

Cars can be replaced, people can't so I'm glad you're OK. If you lived in Texas you would be at fault for hitting the car in front of you. You would have received a ticket for "Failure to maintain a safe folllowing distance" and the truck would be at fault for hitting you. Since you both were ticketed it would end up being a battle between the insurance companies of you, the truck, and the car you hit as to which one would pay for who's car repairs. Most likely scenario, the truck's insurance would pay for your repairs and your insurance would pay for the car in front you hit. However in these multiple car accidents it can get convoluted real quick.

Thanks Blue, that was what I was also told, the only sad part is I was 3 car lengths from the car I eventually hit, but when he went from slowly braking to complete brake, I did not anticipate the complete brake, as i was already slowly applying the brakes since the car in front of me was doing that, the truck behind me essentially shoved me under the car i hit rear.. but like I have asked others and my agent/attorney have all told me, this is going to be a complex mater, because of the nature of the accident, 5 car (domino effect, etc). I dont know when it might be settled, and regardless of what, my insurrance will likely go up, and i will still need to get a new car..

Also, none of us were ticketed, or asked our stories when the CHP came, they just basically wrote a report with all of our names/information, but did not write about who caused or etc. so i dont know how thats gonna play into effect

Thank you again for the input

you could sue the guy in the truck.

They'll interview the guy front of you and ask them if there was 1 bang or 2 bangs....

some SUV pulled this **** on my friend.. and they actually won.. we were shocked...

we just had an accident like that in the Madison area. Depending on why the first vehicle stopped, they may be liable for at least partial damages, as in the case above. Good luck with your insurance!
