Service List....At what point do I get to officially claim LEMON!

Angry Service List....At what point do I get to officially claim LEMON!

Can anyone think of anything else I need done....I'm getting tired of this...I have 22,000 miles on my cp '03.


Windows: Grease Streaks - 3rd time for drivers side, 2nd time for passenger side.

Note - Driver’s side tint (top of window) damaged during last service and nicks in both door speaker trims.

Front Brakes: Squeaks - Both brakes and rotors previously replaced by Infiniti due to premature wear (approx 15k miles). Squeaking currently observed in front left during the last few feet of stopping (approx 22k miles). Check for wearing.

CD Player: Player indicates an Error FO message. Does not indicate discs are in player and will not release discs for player. Head unit replacement.

Seatbelt Retractors: Seatbelts do not retract normally and are often caught in door jams. Retractors need replacement or adjustment accordingly.

Oil Change :-)

Sounds like minor stuff to me. Window could be related to problems with your tint. CD Player should be replaced under warranty and the brakes also.

umm grease was occuring before I had tint put on, thought after two times they would have gotten it corrected...then I had them fix a rattle in the door and that is when they f'e up the tint. Then the grease marks came back...they said the the rattle was coming from the kit they used to fix the grease. wtf??!!

Also having to have brakes replaced twice within 22000 miles is rediculous and not a minor problem.

Get a Lawyer!
Actually there is not much there to go on.
Depending on your state. I got no where with my Acura and the FL Lemon Law claims. You'd need the transmission do drop out of your car like 3 times or something drastic like that before you get their attention. Then I got a lawyer to take the case under breach of the Warranty. And it will take more than a year before the case will even be heard. Live with it, go to a different dealer or sell your vehicle. Find a way to relieve your stress.

im not sure, but i think for a lemon law, problems in your car have to be life threatening... i dont see any!

im most cases they have to be deamed to be serious problems and they get three attempts to fix the problem.

Nothing beats Lexus quality, in my opinion. I love the way my G looks and drives, but the fit and finish is 2nd rate compared to my previous car, a 1993 Lexus GS300. Even though it was 11 years old when I bought my G, it was a quiet car without any rattles and the engine was still silky smooth. I don't think my G will be like that 10 years from now. If Toyota's engineers and designers could be as daring and bold as Nissan's, all of my cars would be a Lexus.

I was just actually at Infiniti for a warranty issue with a ticking in my right rear axle. This was my second time in for this exact problem, within 4 months. Right after January, my rear axle began to tick at low speeds (under 40). I brought it in, they said they retorqued the rear axle on both sides. Few months go by, mid way through last month, the ticking started again. As soon as I sat down with the service manager, he immediatly recognized my car, myself and the fact that I was in for this problem for the second time. He immediatly said Oh, second time, this isn't good. We're going to do alot. Basically, they needed the car all day (from 8 AM). Got a loaner, had no idea how interesting the day was going to be. If you remember my post about the bottle and my mirror, my car was mainly in for this, they already painted the mirror and had it waiting for me that morning. Wasnt supposed to be more than a 1 hour job. Called them around noon from work, they said it wasnt ready, call at 3. Called back at three, he said they had replaced... the rear axle, both sides, both tie rods, all bushings, and a new rear sway bar. Why? because the THIRD time I go in for the same drivetrain issue, its a lemon. A differnt employee (when I picked up the car) actually told this to me so to answer your question, Three identical Drivetrain issues within the balance of the factory warranty warant claiming a lemon.

However, if its something structurally serious. Iie: my friends moms cavy vert that WOULD NOT keep sealed in the rain (and Im not talking about a slight drip, the thing POURED water into the interior) went in three times and was never able to be fixed. She wound up being paid back the price she paid, minus tax, destination yadi yadi ya. She took the car and the money, went to a private shop, had the top fixed, pocketed about 85-90% of the cost she was paid back and was happy. Unless your problem is something as serious as this, your never going to get your car filed as a lemon.

Depends on the state but a vehicle typically has to go in three times for the same mechanical failure. Going in eight times in a year all for different issues would not qualify.

CVC - CA Civil Code Section 1793.22 (Tanner Consumer Protection Act)

1793.22. (a) This section shall be known and may be cited as the Tanner Consumer Protection Act.
(b) It shall be presumed that a reasonable number of attempts have been made to conform a new motor vehicle to the applicable express warranties if, within 18 months from delivery to the buyer or 18,000 miles on the odometer of the vehicle, whichever occurs first, one or more of the following occurs:


(1) The same nonconformity results in a condition that is likely to cause death or serious bodily injury if the vehicle is driven and the nonconformity has been subject to repair two or more times by the manufacturer or its agents, and the buyer or lessee has at least once directly notified the manufacturer of the need for the repair of the nonconformity.
(2) The same nonconformity has been subject to repair four or more times by the manufacturer or its agents and the buyer has at least once directly notified the manufacturer of the need for the repair of the nonconformity.

(3) The vehicle is out of service by reason of repair of nonconformities by the manufacturer or its agents for a cumulative total of more than 30 calendar days since delivery of the vehicle to the buyer. The 30-day limit shall be extended only if repairs cannot be performed due to conditions beyond the control of the manufacturer or its agents. The buyer shall be required to directly notify the manufacturer pursuant to paragraphs (1) and (2) only if the manufacturer has clearly and conspicuously disclosed to the buyer, with the warranty or the owner's manual, the provisions of this section and that of subdivision (d) of Section 1793.2, including the requirement that the buyer must notify the manufacturer directly pursuant to paragraphs (1) and (2). The notification, if required, shall be sent to the address, if any, specified clearly and conspicuously by the manufacturer in the warranty or owner's manual. This presumption shall be a rebuttable presumption affecting the burden of proof, and it may be asserted by the buyer in any civil action, including an action in small claims court, or other formal or informal proceeding.
