PLEASE help - very important

Hi,
Before anyone says anything, yes I know it was stupid to speed, I was running late to work and was in a hurry, I admit my fault and I won't be speeding any time soon.

I got a question, the ticket is below, the officer wrote the statute no violation #39:498, now I looked it up at my DMV's website and it says, that it is 10-14 over the speed limit and that it's 2 points, now if it was #39:499 that the officer meant (as it is said on the ticket), then it would be 15-19 over the speed limit and 4 points. Now, do I have a case or is this a mistake that is not enough to do anything for me.

The reason this is so important is because im 17 right now (with a provisional license) and turning 18 in a month or so and I'm going off to college in a week, taking the car with me. If i do get the 4 points, I will have 7 and i might have my provisional license revoked and it would make things very crappy for me. On top of that, if you have over 6 points, insurance goes up and NJ charges an extra $150 every year for 3 years for having over 6 points.

Lastly, it appears he forgot to put the weight in the box, or it is just my copy and it didn't transfer through, in any case, he had my license and should have written my weight I suppose. Not sure if this can do anything either.



Damn if only i knew this would bring me so much trouble, I definitely wouldnt have sped

I don't have personal experience in a situation like yours, but I have heard that you have a chnce to get out of any moving violation when there are inaccuracies on the ticket. Simply point out the inaccuracies to the judge at your hearing. I believe that in the worse case, all you'll get is probation before judgement, which means that there will be no points charged to you provided that your are not found guilty of any other moving violation within a specified period of time, generally around six months. You will have to pay court costs however.

When you go to court, I can't imagine you not at least knocking it down to 39 in a 25 (so this way you only get 2 points) - But I don't think that weight would really have any influence on anything, sorry.

One thing I just want to point out. He noticed that you had Radar, and checked it on the ticket. Did your radar detector not go off? But this might influence the ticket, since cops deffinetly don't like to see them. If I ever get pulled over, I am quickly ripping out my detector and chucking it in the back. Either way, this cop must have been a jerk.

actually, i think that means that HE was using a radar, even though i didnt see him shoot the gun, i didnt have my radar detector on me, i picked up my car from the dealer that day after they did service and i didnt put it back in the car

btw thats a great point man, i can definitely get it to 39 hopefully

Let us know how it goes. I know us 17 year old New Jeresy punks with G35s are a big enough target enough, but the tickets and insurance points are harsh as well!

oh, I see thats the equipment HE was using. I'm ordering an 8500 x50 soon so I was hoping it didn't fail you!

And yeah I would hope you would be able to get it down to at the bare MINIMUM to a 39 in a 25. Since 4 points and 2 points is a big difference. There has to be some sort of margin of error in the actual speed, and the radar detector. But the cop must have been an absolute DICK to put you down for the one extra mph, instead of going easy on you. Just pray he doesen't show up for court and your off free.

I actually heard of a pretty good technique on these boards which involved finding the cops scheduel out and picking out the most inconvenient time for him, or something along the lines of that, so there is a smaller chance he shows up.

plead not guilty i have no license either mine got taken away in june and i got a restricted license and then while with the restricted license i got 5 more tickets 2 for speeding sooo..yea im 17..as long as u plead no guilty the fine will be lowered by a judge most likely and if u plead ur case u might get it dropped plus ur goen away so the judge will see that and show some concideration

I'd go to court if you have some time. There's always that 35-40% chance he doesn't show up.
It is rough though, it's very hard not to speed in a 25 zone. Thank God for my V1 otherwise I would have been clocked doing 30-35 in the subdivisions they sometimes hide in...

yea man, what i decided to do is, delay it as much as possible and when i come home for christmas break, thats when im gonna deal with this, hopefully the cop gets fired or gets transferred or something so he can't make an appearance

Take it from a speeding ticket guru...get a lawyer or ask the prosecutor to knock it down to an unsafe driving...this will result in no points but u will still have to pay the fine. you are allowed 3 unsafe driving violations before you have to accept a speeding ticket.
