Unfortunatly the cop signed the ticket as not fixable which makes it a 150 plus ticket, but allows me to not take my tint off, but if i dont want to pay that i think i will take my tint off goto court show proff that i dont have tint on my windows, and get the charges dropped (then laugh in the cops face, and flip him off) and then re-tint that same day??? does that sound like a good plan?

I talked(at a wedding tonight) with a LAPD detective and two civil attorneys, one of which used to be a prosecutor. The detective and one of the attorneys tended to believe that the cop had no probable cause to have you pull over. The former prosecutor disagreed.

u can answer his question but dont admit that u were speeding. So if he asked you how fast u were going you say i dont know. Do you know what the speed limit is i dont know or just say i plea to the 5th. Though i dissagree i think u are better off to talk to the cop or aleast coperate a little bit becuase they might let u off.

what's the point of not cooperating? they will write u a ticket regardless. they'll probably be more pissed off if u don't say anything and that'll be an incentive for them to write u off.

Man, here in the Chicago area they do DUI checkpoints almost every weekend, particularly the holidays. For those in the area, Elgin-O'Hare Expressway has them almost every weekend. So if you've been drinkin I highly recommend avoiding that area. But I also highly recommend not drinking and driving.
As far as the tint goes, I thought in California it was legal to have your passenger windows tinted? Here in Chicago it is *very* illegal, and I've heard several stories where Chicago's finest will pull you over just for that reason. I was debating whether to tint my windows or not, but I also refuse to put my front license plate on, and with the tinted windows that would be a double whammy, I bet I'd be gettin pulled over all the time.
Is it legal in *any* state to have passenger side tinted windows??

At trial
· Ask the officer if you ever rolled the windows up?
· If he tells the truth, ask him why he wrote the ticket since he never saw the windows?
· If he says that you told him they were tinted, ask if he informed you of your Miranda rights before asking if your windows were tinted?
· Ask how long you had been detained because you would not waive your 5th Amendment right against self incrimination?
Point out to the judge that:
· Your alleged admission to the officer is not admissible since he did not read you your Miranda rights.
· The ticket you signed says that you sign it without admitting guilt.
· No officer actually saw the windows in question.
· There is not sufficient evidence to meet the standard of "beyond a reasonable doubt."
· "No conviction can be sustained unless the record contains substantial evidence supporting each element of the charged offense." (People v. Johnson (1980) 26 Cal.3d 557, 576-577.) also quoted in People v. Behjat (2000) 84 Cal.App.4th Supp. 1.

Be polite. Hand over your registration & license when asked. Keep your hands on the steering wheel where the officer can see them. Don't get out of your car unless the officer so directs. Roll down your driver side window. Don't answer questions like "do you know why I stopped you" or "do you know how fast you were going".

By the way, when you got yours tinted, what warrenty did you receive for tint bubbling or peeling? I am thinking about getting tint, but I am afraid of the bubbling or peeling. The car is so nice, that I wouldn't want that to happen to it...

i used to go to school in chicago and would drive from indy and back a lot. one time i got pulled over on my way home (i was at least 10 over the limit).
i roll down my window and he shines that bright *** light in my face and asks for license/registration. officer sees my laundry basket with clean clothes and my bookbag and he asks "are you a student?" surprised, i answered "yeah, loyola." he smiles, gives me back my stuff, and goes, "ok slow down because there are speed traps everywhere. and good luck with school."

Yea I have always been cooperative and polite and contrary to what people think, it helps. I've been pulled over 4 times and only got 1 ticket, and the cop even reduced that one to 10 over instead of 15. I don't kiss their ***, I just cooperate without bitching or being patronizing.
