The shop is not going to pay your deductible unless they can get the money somewhere else. That somewhere else is from over-charging the insurance company for the repair. Thanks for all the condolences (sp?) and yes it really does suck when you are without your car. Its def one of the hardest. I saw the complete workorder and invoice. it shows all the costs of the parts and how much its being sold to me. On the invoice it says all the parts and cost for each one. the total at the end comes to 5 thousand and some change. After that it shows a 1000 dollar discount. I am working with the bodyshop and set up a wholesale tire account with them, therefore they are helping me out. So there is no insurance fraud going on whatsoever. They are just giving me the discount and that will cover the deductible of $1000
as for the other vehicle. i dont know how much his would cost. he needs a new drive axle on the left side for sure, new bumper, light, and fender. im assuming not much else was damaged.
I know fraud is immoral and such and it's something i wouldn't do either. But how come some of you guys talk like you have 10 sticks up your @$$ when something with the slightest hint of "swaying from the law" comes along? They gave him a new one no questions asked. When i checked it out, i realized it was a 05 unit that could play mp3's! I figured...what if i brought my car in and told them my player was skipping, won't i get a new one? The dealership gets paid by BMWNA (in fact tech's encourage it because it gives them work to do = how they get paid). My friend jumped up like a couple of u stating that i would be lying/frauding and stealing from the dealership etc... It annoys me so much when some people can't think outside of the box i guess?

flightz71, clearly you are not familiar with insurance fraud. This happens all the time:
1)you got a buddy at a body shop
2)car needs $3000 worth of work
3) you have $1000 deductible
4)They charge insurance $4000 in damage, make their $3k
5)You dont pay anything because your buddy hooked you up
This happens constantly and is why insurance rates are so high, but apparently this guy didnt do this somehow. If I were him I would probably shut up about it, even if he does have a legitimate situation. No offense, but that seems odd.

as mentioned there is nothing illegal about this. I hooked up the guy at the bodyshop, therefore he helps me out. They did not fraud the insurance at all. All they did was give me a great discount which will cover the deductible. So, instead of making $XXX on certain parts, they charge only about 10-30 dollards over cost rather than the normal retail price. With a good deal on the labor as well, this evens out to the 1000 dollars needed for the deductible.
Everyone is always down to jump to conclusions and assume your doing something illegal. Hell I went 50 in a 35 today....thats not legal as well...

If the bodyshop is helping you out, I wouldn't publically talk about it if I were you. It's insurance fraud, and both you and the bodyshop can get into a lot of trouble doing it (and it doesn't really help that you're posting pictures of your car that makes it easy to recognize your car).
But otherwise, make sure they check the inner side of your rims and make sure there's no bend. And ask for a wheel alignment after your car gets fixed.
