Sorry, but there are two possible upsides.

1. you weren't hurt.

2. diminished value claim

Hopefully she has AAA Auto insurance, or similar.

When your car is repaired, take it to the Infiniti dealer and tell them you are thinking about trading it. Tell them you are sueing for diminished value and that once you recieve the check you will be in to trade it. Then ask them to put in writing what you would get for a trade in without an accident, and then again with the accident.

The difference is the Diminished Value.

Write a letter to her insurance company stating you are willing to avoid litigation if they pay you a "Diminished Value Claim" of the difference between the two numbers above.

I got $3500.00 when an elderly man sideswiped my 07 GRand Cherokee SRT8 and then fled the scene.

Usually the insurance company won't fight - especially if it's 100% her fault. It's a relatively new concept, but once a car has hit Carfax, the value always drops significantly.

Just a thought.

And at least she's insured. The damn coyote that ruined my bumper had none.

Damn Sucks Speed! Looks like only that door got damaged? If I were you I would not Have the whole LEft Side Paint-Blended! If it is a reputable shop with good Reports about thier work. I would just have that one door repainted. or just blend the QTR Panel. I've done that too my Black Accord. Just painted the Qtr panel, no blending of doors, and you can't even tell. But it's up to you. And hate to see the G in that condition. If it was my car she did that too, I would have gone BALISTIC!!

sucks man. hopefully you were planning on keeping the car for a long while (i know i am), and so maybe the depreciation sting will be a little less.

i disagree with ppl on here saying somebody should be "hurt" or "killed" etc for a car accident, even in jest. stupid person, maybe. angry at her, okay. but physical violence? grow up.

good luck with your car, hope it comes out lookin' brand new again.

Ugh, sorry to see that Speeed, I would be horrified too. The good news is that your damage looks easy to fix!

+1 on the diminished value claim - my sis-in-law just successfully did that here, and got a couple thou on top of the repairs. No reason you shouldn't get the money, just takes a little work.
