Dude! I think if you sued a judge might agree with the pain and suffering caused! Sorry to hear that!

When your car is repaired, take it to the Infiniti dealer and tell them you are thinking about trading it. Tell them you are sueing for diminished value and that once you recieve the check you will be in to trade it. Then ask them to put in writing what you would get for a trade in without an accident, and then again with the accident.

The difference is the Diminished Value.

Write a letter to her insurance company stating you are willing to avoid litigation if they pay you a "Diminished Value Claim" of the difference between the two numbers above.

I got $3500.00 when an elderly man sideswiped my 07 GRand Cherokee SRT8 and then fled the scene.

Usually the insurance company won't fight - especially if it's 100% her fault. It's a relatively new concept, but once a car has hit Carfax, the value always drops significantly.

Just a thought.

good luck with the diminished value claim.

In minnesota, insurance companies are not required to cover diminished value, so when I got rear ended (7000+ in damages, 2400 in rental car expenses for 2 months, I got rear ended in dec '06 two weeks after buying my '07 G35S) I researched diminished value and insurance companies in MN do not cover diminished value and talking to lawyers they all said it wouldn't be worth the effort. In fact, almost ALL insurance policies written in minnesota specifically excluded diminished value because state law allows them to.

If CT is anything like MN, you're going to hate the answer.

I just went thru 2 years of legal battles with Geico when a woman ran a stop sign and hit my wife in her 2 month old 2006 Honda Accord Hybrid($31000 car). Frame damage, both doors on the passengers side etc. I went thru her insurance(Geico) instead of letting mine(State Farm) handle it. After 2 years and going to small claims court with an attorney and a jury trial, I lost and got Nothing! The jury must have thought I was just after money because I had the best Loss of Value appraiser in the country and still lost. I was lucky I had a friend who was an attorney or it would have cost me more than the car was worth. My attorney still can't believe we lost.

I was hit on the passenger side on both doors back to the rear wheel. The person was doing about 15mph. $7900 in damage. All is well now as I took it to the best of the best shops in the country.
