When I see a pedestrian approach a street with the intention to cross I usually speed up and try to swerve at them a little bit. It backs them up and the problem is solved from my end. Plus it keeps you free from these sorts of legal technicalities.

Then again, if this was a hit and run and the pedestrian died..... it might get a little more heated.
Around here, downtown, you ALWAYS have to be on the lookout for pedestrians (aka the crazy drugged up homeless guys). They'll jump out into traffice whenever they like.

its just me... and i understand the time and cost of suing someone for this, but i would sue the person.
sue for damages, court and attorney costs, mental anguish, etc, etc...
well that's just what I would do. not for the money, for the point.
on another note.... i almost had an incident like this not long ago. I was driving down a major road at night. 4 lane road, with a car next to me. All of a sudden this person ran across the road right in front of us. The other driver narrowly missed the guy. Wanna know why no one could see him? He was a very dark colored black person, wearing a black shirt and black pants!! There was nothing on him that allowed the lights from out car to see him in advance! It's a good thing neither of us hit him because I think he was a bum, so the whole situation would have sucked.
