someone hit my car. I have questions on the repair
3 days ago, this retard hit my car from the rear when I was already stopped minding my own business....
I have questions on having the rear bumper repaired. The damage is very light ... it is almost to the point were you cant even tell it was an accident.... but upon closer inspection you can tell that there's a crack in the bumper scree mount and the paint is peeling. Who knows what other damages it has. I am not here to ask tips on how to fix it myself, but rather my question is what my rights are regarding different type of parts ....genuine parts, like in kind and quality, aftermarket, how to prevent the other party's insurance company from trying to screw me on the repair costs using cheap bumper covers, etc.
What should I look out for? Anyone else had the unfortunate luck to go through this? Did u guys demand a new bumper or get stuck with what they give u? I am from ny

I'm in SoCal and from my experience, the party at fault should cover the necessary cost to restore your vehicle to the status prior to the accident, including your rental. In your case, they'll choose to either repair or replace, whichever is cheaper. It looks like your bumper will be fine with repair; however if it really needs to be replaced, I believe you have the rights to request your body shop to order genuine parts and ask the insurance to cover it. Sorry for what happened to your car and hopefully everything works out for you. Good luck!
