dealer sold me a car with a bad tranny.

Hello, I recently had to get my car tow, to an infiniti dealership since my tranny wouldnt go in gear. It would only go reverse. I put it on neutral went reverse an so on. I purchased the car a month a go from a franchise dealer not infiniti tho ,bought the car as is, had it inspected and checked out good. No mechanical issues. Now fast forward to today the infinitI service advisor tells me there no signs of leaks, no cel codes or anything but does feel a shudder when going reverse. Suggest to replace it with a new one since infiniti doesn't rebuild. I purchased extended care warranty but from a 3rd party from my credit union since I'm also financing with them. Is there any legal action I can take in CA in order for the dealer to take it back if my warranty doesn't want to do the repair. That's my main concern. Car was driving smooth till this month.

There is a CA lemon law, but how long it extends out from the day you bought it, I'm not sure. Just google California Lemon Law

i think the lemon law only covers new cars. because you purchased the car "as-is" the repair is on you. File a claim through your warranty. If they don't cover it i think you are SOL. but you can consult with an attorney to be absolutely sure.

They didn't give you like a 90 day warranty? Most used cars come with that at the least....

ETicket is right. I worked at a dealership and there was a XX point safety check they had to do and there is a warranty against any major problems. Ours was only 60 days though.

OP, listen to e-ticket & Duke's advice. Contact the dealer to see if they will take care of it, your paperwork should also tell you if there is any 30/60/90 day warranty as well.

Also review your 3rd party warranty contract, I would suspect that a trans would be covered.

Dealer 1st, warranty claim 2nd. You should be covered by one or the other. If for some reason neither cover it, you could always get a used or rebuilt one installed for much less than an Infiniti dealer would charge for a new one.

Yea I'm looking into my paper work n it only "says as is". Funny thing car was running smooth till this month. I will be contacting the dealer to see if they can help out. I remember they salesman telling me we don't sell junk cars were a franchise dealership. Lol fast forward to today

In all fairness, sometimes these things do "just happen" tho. It could have been that they didn't even know. We can't reasonably expect that they would pull the tranny, open it up and have someone competent enough to diagnose a potential problem before they sell it. And these cars are so reliable, that its easy to assume its fine.

But either way, they should help you out with it.

idk man "as is" is literally "as is" no warranty is implied

I know I contacted my warranty they won't cover me since I didn't pass 1k miles I only drove 911 or so. So they can't make a claim . since it says in the contract iws warranty btw. The dealer I bought it from will only charge 5k to me no labor. Lol. However I contacted infiniti consumer affair to let them know about my situation. They made a case # I explained on what was going on n how the car doesn't have 60k yet but is out of warranty due to year. Hopefully they help out cause if not then I'm paying for a car I can't drive.

If it comes to it, you could always consider installing a used tranny.

Waiting on infiniti consumer affair to inform me if they can cover the part. I advise them that I'm still under 60k but due to the years I'm out of warranty will see what happens. I'm pretty sure their not going to anything but it's worth a try. Started the case last week and still no direct answer as their telling me that their looking into it lol. I'm suppose to have an answer this Wednesday .
