Kid tried to say it was my fault because I didn't see him as I was backing out...
Long story short, it was determined that the kid was automatically at fault. The way it was explained was that since he was underage and unlicensed, he was by definition "unfit to drive without supervision", and "inexperienced". Therefore, the mere act of him driving without a properly licensed adult over 21 years of age (the law in oregon) the teen was considered "negligent". Apparently if any driver is determined to be negligent, insurance company will always place blame on them first. Hence, he was automatically at fault.

Update:
Finally got everything straightened out and will be making an appointment to get the car in the shop soon. Im not in a rush because our area has been covered in snow lately and I don't let the G see foul weather so it's just been sitting in the garage injured.
Yea, the kid was def 15. He wasn't supposed to be alone. It's 16 in WA.
