Even if he was Im not sure if it would be a factor unless death was involved. I doubt there will be an investigation. Mass was at the scene of the crime, in fact he almost ran down a guy on a bike. He was more concerned with ice cream LOL.
I think determining if the driver was on the cell phone would only be a factor if there was a dispute of who's fault the accident was. It looks like there wont be much of a dispute as to who's fault that is. Definitely go through your own insurance company rather than the other party's insurance...

You have nothing to worry about as far as who's fault it was. It was a rear end collision. It would be very hard to prove it wasn't the OP fault.
Everything check out ok at the doc Steve? Remember, via your "I don't like driving lowered" thread, you are old so you should get checked out lol

^Well said.
Steve, that pic just plain hurts to look at
worst part is looking at that Nismo lip knowing there are a finite number of those things left in the world
the rest of it, I know you'll have back and better than before.
Definitely go in for some xrays, get a copy for yourself (they'll burn you a disk) and take it to a really good chiropractor. Insurance should pay for all of that anyway, and better safe than sorry. I found out later that I was in worse shape than I had thought after an accident I was in (no, not the G, much prior to that)
Hope everything turns out well with you. As for the car, I'm sure it's in good hands

Thanks guys, I did get checked out and got xrays. My neck feels like the guy from the movie "Taken" karate chopped me multiple time.
As far as the G it may be totaled so I have to start thinking about the next step just in case. I need to see what I can get locally at similar value. Nissan built of course.

Looking at your pic makes me sick to my stomach. I know it's just a car, but damn, why yours? I'm glad you seem to be OK +1000 on getting checked out. Looks like you have an excuse to do something different and crazy!!
Just sad images to look at..... Can't believe this happens to your perfectly done 6MT Nismo Sedan. Glad you're fine, and I do hope you can get it back without being declared totaled. Cross my fingers.....
