Massachusetts Bill to Ban the Sale/Installation of Aftermarket Exhaust Systems Is Back . . . Again

After being stalled for the last several years, a bill (H.B. 3574) to ban the sale or installation of “an exhaust system which has been modified in a manner which will amplify or increase the noise emitted by the exhaust” has been reintroduced by Rep. Liz Malia (Rep.LizMalia@hou.state.ma.us). The bill excludes limited-use “antique motor cars” from its scope - a clear attempt by the bill’s sponsor to divide the automobile hobby in an effort to gain clearer sailing for this restrictive and damaging piece of legislation. H.B. 3574 has been referred to the Joint Transportation Committee.

We Urge You to Contact the Members of the Joint Transportation Committee (List Below) Immediately to Request Their Opposition to H.B. 3574

H.B. 3574 ignores the fact that aftermarket exhaust systems are designed to make vehicles run more efficiently without increasing emissions.

H.B. 3574 does not supply law enforcement with a clear standard to enforce, allowing them to make subjective judgments on whether or not a modified exhaust system is in violation.

H.B. 3574 fails to recognize that aftermarket exhaust systems offer increased performance, which can make a vehicle safer by improving its ability to merge, pass, travel uphill, etc.

H.B. 3574 would make it difficult for hobbyists to replace factory exhaust systems with more durable, better performing options.

H.B. 3574 would only exclude “antique motor cars” defined as those vehicles over 25-years old which are used exclusively for exhibitions, club activities, parades, etc.
DON’T DELAY! Please contact members of the Massachusetts Joint Transportation Committee immediately by phone or e-mail to request their opposition to H.B. 3574.

Please e-mail a copy of your letter to Steve McDonald at stevem@sema.org. Thank you for your assistance.

Massachusetts Joint Transportation Committee

this law is about selling aftermarket exhausts... Which will never happen because alot of older cars need aftermarket exhausts. Anything pre 90's will not have any original factory parts in production or stocked.. What happens is aftermarket companies replicate a close to factory spec system..

What I'm talking about is chapter 90-16..
http://www.mass.gov/legis/laws/mgl/90-16.htm

Any modified exhaust is illegal. period.

exhaust & tint = TICKET.. thats how it is in MASS. legal or not, the time it takes to fight it, not worth going to court. if you decide to appeal. you have to show up at the 1st hearing and pay $20 for a 2nd hearing, that dosent mean it will be in your favor. thats 2 days off work and alot of driving back and fourth from court. the CIVIC ricers ruined it, with their loud coffee cans.. but if you have flowmasters on your truck, its ok. cus ITS A TRUCK! they aint going to bother youwhen youre in a truck.

I haven't read through all three pages, but I know Porsches come STOCK with clear corners... that's a BS ticket. I bet it'll be thrown out. Just make sure you have an amber bulb in there.

is it just me that finds that ironic? it's legal to sell/install aftermarker exhaust in Mass, but it's ILLegal to have it on your car...

"No person shall use a muffler cut-out or by-pass. No person shall operate a motor vehicle on any way which motor vehicle is equipped (1) with a muffler from which the baffle plates, screens or other original internal parts have been removed and not replaced; or (2) with an exhaust system which has been modified in a manner which will amplify or increase the noise emitted by the exhaust."

I guess my open dumps are illegal o well...not like i'll be hitting full boost driving by a cop anyways

The thing is, even if you have a 3 inch open exhaust, if you have a turbo it'll obviously muffle the noise significantly. Matt, I've heard a fuji exhaust on a non-turbo car and it sounds completey diff than on yours. Hopefully the twins will muffel my evoTT enough so it'll just be a deep rumble and not a fart can. I rarely see Evo's and Sti's being pulled over for a loud exhaust.

Andy, I read on the STi forums a story of someone with a STOCK Sti exhaust getting pulled over and ticketed (on Rte 9) for a modified exhaust. They do get harassed just because it's a loud exhaust. This was just a month or two ago

damn...still, i would say the ratio of ricers getting ticketed opposed to evo/sti/cobras/vettes is no comparison...I think a lot of it has to do with profiling too. Have you heard a stock Z06 exhaust at WOT? It's f'ing loud...not to mention the black maserati i hear every day on boylston. You'll never see them being ticketed.

Andy you've got a good point. I see Mustang Cobras go by grumbling like it's the end of the world and they don't get pulled over. My friends little brother drives an SRT-4, bone stock and those things are stupid loud. He gets pulled over once a week and has to explain that that is how the car comes from the factory.

ya i actually just got pulled over for my exhaust today on the way to work. i have the hks exhaust. the guy was suck a d!ck he pulled me over only for the exhaust wasn't speeding or doing anything else wrong. then he started questioning how i could afford such a nice car at 19 years old. i told him i work at an engineering company, which is where i was heading. for some reason he didn't buy that and started harassing me about selling drugs. he proceeded to make me get out of the car because "my pupils didnt look normal to him". it was 6:30 i had just woke up i was tired!!! then he started to search my car because he thought i was selling drugs or something to pay for the car. needless to say he didnt find anything and must have felt like an *** because he didnt give me a ticket.

That's pretty terrible dude. I would have been so pissed. Sounds like the must be tightening up or trying to pull over anyone since the nice weather is coming out.

There is no such thing as "DOT Approved" Parts. the DOT couldn't possibly approve every part going on cars from factories, never mind aftermarket. The DOT stamp you see on factory parts means it meets or exceeds DOT specifications.
Anyone can put DOT on any part. Doesn't mean it meets specs. I don't know how a clear lens will reflect yellow/amber. It may light up amber because of the color of the bulb inside, but what color will it appear when light from another car's headlight shines on it? The purpose of the front amber and rear red reflector lenses is so that oncoming cars can see the size of, and the direction of travel, of a car, in the event it's lights are off. It's like all those cool lights on big-rigs, they help you identify the size/shape of the vehicle.

Most mass courts are pretty easy on m/v violations, if you have a decent driving record. It's a liberal state where convictions are near-impossible for serious felonies, the yuppies don't care about mv stuff...
As though people actually look at a side marker of an oncoming car for size right?

If that's EXACTLY how it went down, I agree that was a shady search. When's the last time you smoked in your car? That smell lingers, and the smell alone is PC to search.
