Need some help, scammed by forum member?

I know this is a long post. I’m just a car enthusiast trying to present the facts and resolve this issue. Also, I don’t mean this to defame anyones character.

On 5/31/04, Jaerian (active member of G35Driver.com) posted on My350Z.com that he had Nismo cams for sale. Here is the post:

I am selling a brand new set of Nismo R-Tune cams. These are new in the box, never used. I am selling them for $800 shipped. Please PM if you are interested thanks. Also have a NX Express Wet Kit for EFI, complete and brand new $350. Please PM Me if interested.

Yes, they are available for now, I have a couple of buyers but none have shown any seriousness, they are new in the box and packakging still.

My check to Jeremy cleared on 6/7/04 and that’s the last time I heard from Jaerian. He has not answered my PMs or phone calls.

So, Jeremy, what’s the deal? If you take my money, I expect you to send the merchandise you advertised. If not, I expect my money to be returned.

I’m hoping that someone that knows Jeremy can give him a gentle nudge to do the right thing here; i.e. send the cams or return my money. Maybe a Team Transport member can help me with this.

I know Jeremy personally and also know there's a reasonable explanation for his actions. I'll call him and get him to get in touch with you. He'll prolly post there to let all of the other TEAM members know he's not a criminal.

I thought you were going to stop tricking ppl into to sending you money for parts you don't have or ever owned! Why sdon't you just tell ppl that you drive a Honda Civic (GO VTEC!) and wish you had a G Sedan in the shop right now waiting for a TT setup to complete! =)

I have sent you a PM a while back in regards to the cams, I automatically assumed you were going to wait until I received my car back. I heard no response for you and do not have a contact number, you on the other hand have my contact number, but never called. We can go back and forth here on this forum which does not matter to me or you can contact me and we can figure out if you want to wait or get a refund its up to you. My PM to you stated all that, since you did not respond I assumed you wanted to wait. TRUST ME I DON'T NEED YOUR MONEY. You can either call me or email me. The best way is to call my office number which you should have and speak to Eric and he will give you my cell number, as I am never in the office.

I have had a problem with jerian also. I sent a procharger kit out to him that he agreed to buy and new he needed a certified check and tried to get me to change it to a regular check which UPS would not allow and he told UPS to return shipment. He said that his bank would charge him 10% to return his check and get another one issued. I called his bank and that is a lie. Then he wanted me to resend it to him because he was still interested. He had me working through this guy Eric as well because he would never return any of my numerous phone calls. I was getting ready to resend it and Eric confirmed he had the check in his hands but to busy to fax me over a copy. He told me that Jerian had gotten a certified check, so I asked him how much the check he was holding in his hands(to see if he was lying or not) and he paused and guessed $4200.00. It was very clear that the amount was 4178.50. Jerian new the amount to get the check for. I would of been out of another $175.00 or the whole procharger if I would of sent it. Jerian and Eric never tried to contact me. As far as I am concerned Jerian stole $175.00 from me. Rich

Now I will explode, your f##king idiot!!! My bank also neglected to tell you that this money was drawn from my business account, which is two seperate account, general accounts do not get charge, but when you do a transaction through your business account there are no special previliges. Eric said he would fax it to you but to call back and give him your fax number, we have a business to run here and he was busy at the time, you never called. Since you did call my bank then you would know an association check is a cashiers check, so try again. We ask you to tell UPS to accept an association check never a personal. So if you want to talk about being out money, I lost $420 cancelling the association check. If you want I can fly to Florida and shove this freaking statement down your throat. I even PM you to see if it was on its way back. So grab your nuts and suck it up, if you can't afford to loose $175 bucks then shut the f*** up. Other then that you screwed up. I took the lose and this is the first I heard from you since Eric told me you called. So basically you ended up costing my double what you lost.

Randy,

I thankyou for your support, but you have to understand my point, I am not going to run and hide from this, because the communications were screwed up during the transaction. In no way am I trying to get over on any one, those who know saw I have the cams, but I don't have my car, which the is where the cams are in there box, not in the engine. Also this other clown, knows I had a cashiers check for him, but unfortunately on the check it say association check, which is how my bank reference a certified check, UPS will not accept it, I told the guy to resend stating they will accept an association check, but know the guy makes it more difficult then it really is. I guess your I will save my breathe.

Ok ok. NOw the issue has been cleared up and knowing that Jaerian is at no fault. LEts just shake hands and leave this be.

Jaerian you are now clear of any charges! :P Says who? ME! :P WE are all G brothers, so lets not really accuse anyone of being whatevers. If we have an issue, lets be calm and talk about!! Be nice guys!! You guys will find that the nicer you are in trying to get something through to someone is alot easier than being harsh!!

Hey guys I appreciate all the support here!!! Which is why I am so frustrated that it got escalated this far over miscommunication. I respect everyone in this forum, I think its great which is why I attend meets and so forth. Last thing I want to do is burn bridges, especially in forum that taught me alot about my car, (see I'm crying now), J/K, but anyways Brian give me a call and we will handle this. As for Rich, its just tough that we could not complete the transaction over just minor details, but may have been a blessing since I was able to get a TT setup going. Thanks guy, I hope this thread dies.

Thanks for the replies, Jeremy. In all honesty, all the PMs I received I included in my original post. I had no knowledge of the cams being in your car. The last PM I received implies they were ready for shipping. If I misunderstood, you have my sincerest apologies. Like I stated in my original post, I'm not trying to defame anyone's character or accuse anyone of anything. I had not received the cams nor could I reach you via PMs or voicemail (yes I have left several messages, at your business and the contact number you gave me), so I felt I had to use this fourm. A simple return call would have gone a long way to avoid any hard feelings for the both of us.

I'll give you a call so we can iron out the details.

Again, thanks for your replies, and my apologies for any miscommunication on my end.
