to my knowledge, you will have to apply the new account under a different name. you might be able to get away with the contract (but it depends on who you purchase the phone from) they have 6 month grace period, if you cancel within 6 month, the dealer who sold you the phone will not get their credit (which the dealer use it to pay for part of the cost for your phone) so if you cancel with in 6 month, usually dealer will try to get that money from you. again, it depends on how much discount you get for your phone and who you purchase it from.
or if you want to use the same name using cingular again, you will have to wait for at leaest 6 month. That's how long Cingular will restrict users from canceling a contract and starting another contract just to get free or cheaper phone. For most of the people now, phone is not the only concern, but the number. Most of the people would like to keep their cell phone numbers, and that's when you lock yourself with the same carrier, switching carrier or pay $$$ for a new phone...

Good Phones
I Have the sony S710a and it is a good phone. Do not spend more than 300$ or you will be geting riped off. Also if you like the sony phones you should look at the w800i this is a really cool phone. Good pictures and you can listen to music(MP3).
Also another good phone is the Treo 650. This is the best all around phone for anyone..
Ebay is a good place to get a phone. Another good place is Wirefly.com. Wirefly requires a contract.
Also cingular has on their web site a treo for 130$ referbushed. My friend got one and she had the insurance and claimed it lost, and got a new one. Currently she is having the other phone unlocked(15$).
