35 Miles over speeding limit on Local Street..help..

Got a little emotional while driving and step alittle too hard on the paddle down the hill within a half mile distance.. got pull over for 80mph at a 45 zone... any possibility on fighting the ticket? and how much it might cost me?

speed aprox: 80

Radar/Laser: not clear what he wrote.. "Fro 80?"

some more info : Location at State College Rd. Fullerton, California

I turn right on to State College and start going down hill. In less then a 30 sec., in a sudden,a car cuts right in front of me, usually I would just slam on the break.. but I guess I was little emotional that day and took the other route decided to change lane and as car approach from the back, so I speed up the avoid being hit. But i guess I didn't notice the speed I was going at and by the time I realized and hit the break,the officer already behind me with siren on. and It all happen in less then a mile in distance...

isn't 22350 for highway? anyone got any info on this, any help will be greatly appreciated!!!
No, 22350 is just for "Unsafe Speeding" well, at least it's okay ticket... not a terrible one.

If he had a radar record on your speed......then, you lose...
So just plead guilty and try to get lower fine when you show up on the court date. (If you are a college kid, you can just say you go to college, and you can't afford it. and tell the judge it's not your car, since G35 isn't cheap car to have )
Or plead not-guilty and just cross your fingers and hope the police won't show up on the trial.

I heard one person won really luckily, even though he had a radar record... like saying malfunctioning radar equipment at the trial.( not on the court showup day)
But I think it's very rare that you can win......
80mph, is obviously too fast for 45 mph limit..If you were going on the freeway, you might want to try to fight for it....But...

I think the ticket will be close to 200.. I am not sure where you got this ticket...You also need to which county, which street...but since the street had 45 limit...then it's not that expensive with one point violation.

Honestly, best of luck to you. In my experience, and believe me, it's a lot in the last 10 years, you are lucky you didn't get an excessive speed ticket, which would be completely unfightable and a possible two-points. Which then would mean asking a judge for traffic school, to which even if he did agree to it, would mean double the normal hours. Typically, going 20 miles over the limit will land you with one of these. I've had one. or two... On top of that, it can be a two part violation where they slap you with reckless driving. 20+ can be considered one or both. And just a little bit more, driving over 100+ can be a felony and can land you without your car and possible jail time. But that is so friggin rare.
But, back on point, your best bet is to ask for traffic school. I've heard of people writing statements or getting attorneys, but going double the limit is easy to identify and not easy to fight.
It comes down to the situation of just owning up to it. It would be one thing if it was 5 miles over the limit, but 20+ over is too much. Not to knock you, but the argument will be made that one should pay attention to downhill speeds.

Sorry, can't offer any experience on this though. I've always just accepted it. I am considering writing a declaration for my recent ticket, but not sure if I want to risk it yet.
Lastly, if you have a record of a few tickets already, pleading in person, in front of the judge won't help. He/she will likely respond with the fact that you are a repeat offender. At which point you are screwed.

hey Mr. A, i found that sight to be pretty informative, good find. i jus' got a ticket, too, but it was going around 85 in a 65 over in escondido. i'm not sure if i'm going to fight it, he didn't have a radar ticket, but i think i could just sit through traffic school to avoid the hassle.

Back in June, i got rolled in Commerce going on the 5N.

Got slapped with a ticket going 90 in a 55.

I recently sent off my trial by declaration form and statement.
In the statement i had a short statement stating:
I am NOT GUILTY. I was NOT speeding. The officer's speedometer/radar was malfunctioning.

This was advice straight from a local TICKET-HOUDINI Dizz.
Homeboy's my fuggin hero.
He's beaten 5 tickets in a row.

Burden of proof is on the officer.
He said he was pacing me for a good while.
He didn't even hint to having a radar reading.

If the CHP officer that rolled me fails to write a statement of facts from his end. Case dismissed.

If he does and the decision goes against me, i'll meet his a$$ up in court for Trial de Novo.

We'll see what happens.

But in your case, fight it as well.
Don't take it lying down.
If u can get out of it... get out of it.
Save that Traffic School Option til the very end.
Who knows when you'll get popped again for somethin else?

hum.. pretty much what I said was " I just had a fight w/ my gf and I didn't notice what speed I was at"... and he go on and on lecturing me on how fast I was driving and that I could have endanger other ppl's life and etc.. and ask me if I understand etc.. and I say "if i drove that fast... i guess that's bad..."

does it mean.. i admit guilt?... dame...

too old for college kid, and the car is under my name too.. don't think malfunction will be off by 35 miles.. so hard to use that excuse... I heard it will be at least $300+ and no traffic school will be offer since it is esceed over 25mph... thanks for the suggestion thou!

Thank you so much for the info, I found it very interesting... how is doing a declaration a risk? What consequence would I get if I don't win? I was going down hill and a car cuts me off, usually I would just slam on the break.. but I guess I was little emotional that day and took the other route decided to change lane and as car approach from the back, so I speed up the avoid but i guess I didn't notice the speed I was going at and by the time I realized and hit the breakl,the officer already behind me with siren on. the last speeding ticket I got was.. about 3-4 years ago.. and this would be my third speeding ticket in like.. 10 years, any other suggestion will be greatly appreciated!!!

I guess I might try that option, let me know how your case go, I guess we are both around 35 over limit, can we still pled for traffic school after trail of declaration failed?

Yea the fine of a speeding ticket is typically $10-15 x number of speed over the limit. In your case it'd be $350-525. This is what I'd do...don't play the fine and request a trial. I hope you remembered the officers face because when it comes time in court, if you don't see him, you're 90% sure he's a no show. If he is there, plead guilty and ask the judge to reduce the fine due to financial hardship. If this is your first offense, your judge may opt for community service at your request.

I got a 90+ in a 45 zone once and the fine was 321 with no traffic school. I went to court and asked for traffic school since I had never gotten it before and they gave it to me. So I ended up with 321 + court fees (20 bucks) +35 for online traffic school. Cop was cool I guess, I mean 90 is too fast I agree.

Just go to court ask for something reasonable and you'll usually get it. Don't ask for no fine, no points! That's a sure fire way to get the book thrown at you.

everytime i go to court, the cop ALWAYS show up.. no such luck.. ever. yet...
500+ is way too crazy.....
