Why is there so few honest people in the auto industry?

Obviously the thread title is a rhetorical question. But here is the story.

So last week on friday I got a call from Action Tire in Lodi, NJ which is where I had my K40 installed and my tints done. So far they have been a great shop to deal with - until now. They have a great reputation but it seems to be based on the past and they are NOT stepping up to their standards.

Sorry - anyway - when I got the call on Friday they had told me the K&N intake wasn't available because it was on backorder until mid February. He offered me instead the gen 2 Stillen intake which I regretfully accepted. I figured that since the K&N was on backorder that they wouldn't be so readily available in any shops but I learned differently on Saturay when I posted that "Where to find K&N Typhoon?" thread.

So I called them back on Saturday and told him to cancel it which wasn't an issue. He told me he would take care of it on Monday. Well Monday - today came and he called and told me the order had shipped and he wouldn't be able to return it or anything - in his words "it was coming from california". I guess there's some sort of law I'm not aware of that all sales are final from California - jackas*es.

I just talked to Andy at HPautoworks and he is possibly one of the nicest people I've met in this business and really tried helping me as much as he could. He told me he'd send me the K&N intake once I figured this out but I don't know what to do.

I'll accept a restocking fee and cut my losses but I don't want this stillen intake - I'd much rather have the K&N. Should these guys take this stillen back or are they right? (I don't think they are).

Sorry for the long draw out post but what should be done here?

PS if this doesn't work out the way I want it to I'm willing to sell the Stillen intake for a great price. I'm paying $400 right now for it (will obv sell it for much less) so if anyone wants it just shoot me a PM. I promise a great price and it will be brand new.

IMO, if the order had already shipped by the time you called on Saturday, then it's your loss. On the other hand, if the order had NOT shipped, then they should have cancelled the order completely.

The key here, is when the order actually shipped.

That's the problem. I'm convinced that this order didn't ship until today because he didn't order it until late Friday (unless he ordered it without my permission). I went to him the very next day in the early afternoon to cancel it which he said he would. Stillen wouldn't give me any information on when it shipped either when I called before.

Personally, I do not order something and the buy something else hoping to cancel the first item. Sooner or later, you will be buying two items.

If I recall, I think Stillen is selling an "upgrade" path to convert a Gen2 to Gen3. Maybe the Gen3 is just the front pipes that hook up to a Gen2. If I were you I would seriously get the upgrade if its available. I don't think you will have difficulty selling a K&N or a Gen3 (for a small loss, of course), compared to selling a Gen2.

I think you're SOL. Many businesses that ship things have a certain point as to where the order can be cannot be canceled. If he tried to cancel it today, he may have been too late. It could have already been packaged and shipped. I don't think the shop is at fault at all, because who knows maybe it did get shipped on Friday.

That is a good point.

No I understand now the shop isn't at loss. I was just venting pretty much I guess about my own idiocy. I never bought the product with the intention of canceling the order and I acted as quick as I could but I understand I made the mistake not them.

I guess I need to get a hold of the tracking number before I can really do any type of blaming.

So anyone want a gen2 intake? Insane gains and great sound - lol.
