Dealer put on a wrong tire!

Angry Dealer put on a wrong tire!

Well, some of it's my fault.. When I initially bought the 2004 infiniti G35c 6MT w/ brembo, right front tire had a lil bulging.. the Dealer said they'll replace it for free (it cost them $335 total for pilot sports at local tire place.) THe dealer had the receipt, but for some reason I forgot to take the receipt (I know why I forgot.. I was TOO EXCITED TO DRIVE!!1!) Anyways..
So 2 weeks later, I was noticing that my suspension looked lil wierd.. and when I was putting air in the tires, I noticed that they put on 245/45/18 on front right instead of 225/45/18.. So bascially all wheels except front left is running 245/45/18..
I spoke the the dealer about getting this fixed.. dealer said they still had the receipt but they said they spoke to the tire place and said that it's a very expensive tire and used so they are very hesitent on replacing it w/ proper size. (Yeah.. I was pretty mad at this point - at them and partially at myself for not checking thoroughly.)
So I need some ammo to fight the dealer+tire place.. I think 245 is about 0.7 inches greater in diameter than 225 which may explain my suspension looking wierd.. Besides that, will this pose a safety risk? (like i may crash and DIE if i make emergency maneuver/braking cuz VDC is all messed up?)
I'm gonna speak w/ the again tomorrow.. hopefully they can fix this up..

A couple things here:

1. You must never replace just one tire (unless it's very low mileage). When replacing, you must always replace two on an axle, with the same size and model of the tire. With performance tires, replacing all four is best.

2. The dealer has a liability here. He screwed up plain and simple, as did the tire shop that installed the tire. I'd insist on two front tires of the correct size (225/45/18). BTW, 245/40/18 will work, keep the stagger, and reduce understeer a bit.

3. In any event to maintain the correct handling of your car and the proper operation of your vehicle, you need to maintain the proper stagger. Different size tires with different wear on the same axle is ridiculous, and unsafe. If the dealer wont satisify you, go to Infinity North America.

And it's not your fault, the dealer has an obligation to make sure any vehicle they work on leaves the shop in proper operating condition. They didn't.
